【摘要】：對教育政策決策行為背后思想依據(jù)的考察是深刻理解教育政策的關(guān)鍵。本研究以美國廢除公共學(xué)校種族隔離政策為例,探究最高法院的法官們決策時重點考慮的問題以及為何如此決策。決策基于對當(dāng)時美國社會現(xiàn)實的思考,與三權(quán)分立原則下最高法院的權(quán)限、聯(lián)邦制原則下教育在美國憲法中的定位有關(guān),是當(dāng)時歷史條件下所能得出的最有利于教育公平的選擇。
[Abstract]:The study of the ideological basis behind the educational policy decision is the key to a profound understanding of educational policy. Taking the abolition of segregation in public schools in the United States as an example, this study explores the issues that Supreme Court judges focus on when making decisions and why. The decision was based on the consideration of the social reality of the United States at that time, and related to the jurisdiction of the Supreme Court under the principle of separation of powers and the orientation of education in the Constitution of the United States under the principle of federalism. It is the best choice that can be obtained under the historical conditions at that time.
