低齡觸法未成年人教育矯正研究

【摘要】:2009年以來我國未成年人犯罪數(shù)量得到了有效遏制,但未成年人犯罪低齡化的形勢卻日趨嚴(yán)峻。在傳統(tǒng)的未成年人刑事司法研究范式中,由于低齡觸法未成年人對任何犯罪行為均不承擔(dān)刑事責(zé)任,所以不在刑事司法的研究范圍內(nèi)。在少年司法研究范式中,對于未成年人犯罪行為的研究繼承了未成年人刑事司法研究范式中的觀點(diǎn),對于未成年人不良行為的研究則集中在14歲以上的年齡范圍,我國低齡觸法未成年人的教育矯正問題處于研究的起步期。在矯正實(shí)際操作方面,由于法律的修訂和矯正機(jī)構(gòu)的改革,我國原有的“工讀學(xué)校-收容教養(yǎng)-未成年人管教所”的矯正模式在矯正低齡觸法未成年人方面已趨于崩壞,低齡觸法未成年人的矯正實(shí)踐處于制度的空白階段。本文圍繞低齡觸法未成年人這一特定群體,基于多元化開放性的教育矯正視域,進(jìn)行系統(tǒng)的理論分析,探討低齡觸法未成年人的教育矯正策略與路徑。低齡觸法未成年人的教育矯正問題,是一個(gè)多學(xué)科綜合的研究問題。需要打破學(xué)科的藩籬,從多元化的大教育視域出發(fā),立足教育矯正的終極關(guān)懷,探究對低齡觸法未成年人的教育矯正的價(jià)值預(yù)設(shè)、價(jià)值承諾和定位問題等。以此為理據(jù),展開對低齡觸法未成年人教育矯正價(jià)值本體探究,確立幸福成長作為教育矯正的價(jià)值本體。從價(jià)值定位的本體性承諾出發(fā),在對低齡未成年人觸法原因進(jìn)行定量分析的基礎(chǔ)上,進(jìn)一步探究對低齡觸法未成年人實(shí)施教育矯正的策略及途徑問題,從而達(dá)到心靈轉(zhuǎn)向的教育矯正目的。第一章對低齡觸法未成年人矯正的歷史發(fā)展和現(xiàn)狀進(jìn)行梳理。兒童概念的認(rèn)知、刑事實(shí)證學(xué)派的教育刑思想被廣泛認(rèn)可,為少年司法奠定了理論基礎(chǔ)。通過文獻(xiàn)研究的方法,總結(jié)了少年司法制度的特點(diǎn)和現(xiàn)行的少年司法分類,并分析了我國對于低齡觸法未成年人的認(rèn)知與矯正方法的發(fā)展過程,從中了解目前我國低齡觸法未成年人矯正中存在的問題。第二章對低齡觸法未成年人教育矯正進(jìn)行理論探討。通過分析低齡未成年人活動場所、認(rèn)知的特征,了解低齡未成年人的特殊性。借鑒社會失范理論、差異接觸理論和社會紐帶理論對于犯罪行為的研究及原因揭示,為探析低齡觸法未成人的教育矯正問題提供了分析和研究犯罪問題的認(rèn)識論和方法論以及可資借鑒的思想觀點(diǎn)。從教育矯正的終極關(guān)懷出發(fā),展開對低齡觸法未成年人教育矯正價(jià)值的本體探究,提出幸福成長為教育矯正價(jià)值本體的觀點(diǎn)。第三章以低齡觸法未成年人為研究對象,運(yùn)用青少年生活滿意度量表、情緒體驗(yàn)量表為數(shù)據(jù)收集工具,探究低齡觸法未成年人的觸法原因。主要結(jié)論如下:主觀幸福感與低齡未成年人觸法行為呈負(fù)相關(guān)。其中,情緒體驗(yàn)中,積極情感與低齡未成年人觸法行為的發(fā)生幾率成負(fù)相關(guān),而消極情感與低齡未成年人觸法行為的發(fā)生幾率成正相關(guān)。與生活滿意度總評分與低齡未成年人觸法行為的發(fā)生呈負(fù)相關(guān)。生活滿意度的六個(gè)維度中,友誼和自由滿意度與低齡未成年人觸法行為的發(fā)生呈正相關(guān);家庭、學(xué)校、學(xué)習(xí)和環(huán)境滿意度低齡未成年人觸法行為的發(fā)生呈負(fù)相關(guān)。生活滿意度對低齡未成年人觸法行為有預(yù)測作用,構(gòu)建Logistic回歸模型:logist (P) =13. 025+0. 47 X友誼滿意度-0. 44 X家庭滿意度-0. 374 X學(xué)業(yè)滿意度+0. 256X自由滿意度-0. 290X學(xué)校滿意度-0. 265X環(huán)境滿意度。第四章分別從法治教育、傳統(tǒng)文化、人格完善、生態(tài)協(xié)調(diào)四個(gè)方面,探討了觸法低齡少年的教育矯正策略。一是從突破學(xué)校法治教育瓶頸、養(yǎng)成法律意識、強(qiáng)化公民意識、建立法律信仰四個(gè)方面,探討了基于法治教育的法治策略;二是從德主刑輔、道德自律、德行自覺三個(gè)方面,探討了基于傳統(tǒng)文化的德治策略;三是從“養(yǎng)心”、“育心”、“化心”、“正心”四個(gè)方面,探討了基于人格完善的心治策略;四是從優(yōu)化以家庭為核心的微系統(tǒng)教養(yǎng)策略、深化以學(xué)校教育為重點(diǎn)的融合互動策略、凈化社會教育的網(wǎng)絡(luò)媒體引導(dǎo)策略三個(gè)方面,探討了基于教育矯正生態(tài)結(jié)構(gòu)的綜治策略。這四個(gè)方面共同構(gòu)成了具有系統(tǒng)性與邏輯性的教育矯正策略方案與內(nèi)容體系。第五章是對低齡觸法未成年人教育矯正路徑探析。首先從虞犯制視域進(jìn)行教育矯正的路徑探析,對虞犯制度與我國《預(yù)防未成年人犯罪法》的內(nèi)涵與矯正方式進(jìn)行比較分析,從建立擁有“先決權(quán)”的裁判機(jī)構(gòu)、擴(kuò)大社會調(diào)查的范圍、完善轉(zhuǎn)向處置制度、改革工讀教育四個(gè)方面,提出了完善教育矯正機(jī)制的路徑。其次是從“仁愛”、“正義”、“克己”、“誠信”四個(gè)方面,分析了教育矯正的主題性路向選擇。三是從抓早抓小的規(guī)則教育、公權(quán)介入的家庭監(jiān)護(hù)、全程一貫的法治教育、有針對性的特色教育、以低齡觸法未成年人為主體的自我教育等方面,探討了教育矯正的過程性路徑拓展。四是圍繞低齡觸法未成年人的幸福成長推進(jìn)價(jià)值建設(shè),從重塑教育矯正價(jià)值的本體論擔(dān)當(dāng)、促進(jìn)低齡觸法未成年人幸福觀的轉(zhuǎn)型建構(gòu)、提升教育者的幸福感知和幸福觀、營造有利于低齡觸法未成年人成長的教育環(huán)境和心理環(huán)境四個(gè)方面,探討了低齡觸法未成年人教育矯正的價(jià)值本體回歸之路。
[Abstract]:Since 2009, the number of juvenile delinquency in China has been effectively checked, but the situation of juvenile delinquency is becoming more and more severe. In the traditional juvenile criminal justice research paradigm, the juvenile delinquency is not responsible for any criminal act, so it is not within the scope of criminal justice. In the annual judicial research paradigm, the study of juvenile delinquency has inherited the view of the juvenile criminal judicial research paradigm. The research on the bad behavior of minors is concentrated in the age range over 14 years old. The education correction questions of the juvenile delinquency juveniles in China are at the beginning of the study. On the other hand, due to the revision of the law and the reform of the correctional institutions, the original correction mode of "the work reading school - the rearing rearing and the minor Management Institute" has tended to collapse in the correction of the juvenile touch law minors, and the correction practice of the juvenile touch law minors is in the blank stage of the system. A specific group, based on the pluralistic and open educational correction horizon, carries out a systematic theoretical analysis to discuss the strategies and paths for the education and correction of juvenile touch law minors. The problem of the education and correction of junior touch minors is a multi-disciplinary research problem. On the basis of the ultimate concern of educational correction, this paper probes into the value presupposition, value commitment and positioning of the juvenile touch law minors, and probes into the noumenon of value noumenon for the education and correction of the juvenile touch law minors, and establishes the happy growth as the value noumenon of the education correction. On the basis of quantitative analysis of the reasons for the touch of law of low age minors, this paper further explores the strategies and ways of implementing education correction for juvenile touch law minors, so as to achieve the purpose of educational correction for the mind turn. Chapter 1 discusses the historical development and present situation of the correction of juvenile touch method minors. In the mood experience, positive emotion is negatively related to the incidence of legal behavior of young minors, while negative emotion has a positive correlation with the incidence of legal behavior in low age minors. The total score of life satisfaction is negatively correlated with the occurrence of contact behavior in low age minors. In the six dimensions of life satisfaction, friendship and freedom are satisfied. There was a positive correlation between the degree and the incidence of legal behavior of young minors; family, school, learning and environmental satisfaction were negatively related to the occurrence of legal behavior.
