【摘要】：在農(nóng)村土地信托制度中,農(nóng)村土地信托財(cái)產(chǎn)是整個(gè)制度的核心。在嘗試以商事信托來促進(jìn)土地權(quán)利高效流轉(zhuǎn)時(shí),如何在財(cái)產(chǎn)權(quán)理論方面予以合理融合；作為土地信托法律關(guān)系客體的信托財(cái)產(chǎn)范圍如何；農(nóng)村土地信托理論及實(shí)踐過程中還存在哪些發(fā)展困境；克服這些困境應(yīng)當(dāng)選擇何種路徑；可否構(gòu)建完善的農(nóng)村土地信托財(cái)產(chǎn)體系。 面對(duì)以上問題,本文試圖通過以下思路進(jìn)行論證：第一部分從信托財(cái)產(chǎn)的概念及內(nèi)涵出發(fā),指出信托財(cái)產(chǎn)具備的特殊法律性質(zhì),并由此概括出何種性質(zhì)的權(quán)利才可以信托方式進(jìn)行流轉(zhuǎn)。在此基礎(chǔ)上對(duì)于農(nóng)村土地權(quán)利以信托方式流轉(zhuǎn)過程中涉及信托財(cái)產(chǎn)的基礎(chǔ)問題予以闡述,為隨后的論述奠定基礎(chǔ)；其次,對(duì)農(nóng)村土地信托相關(guān)政策、法律法規(guī)進(jìn)行梳理,并結(jié)合現(xiàn)今土地信托實(shí)踐,可知土地信托財(cái)產(chǎn)存在類型單一、獨(dú)立性未受足夠重視、公示制度不完善等發(fā)展困境；再次,克服發(fā)展困境,其價(jià)值取向應(yīng)當(dāng)是效率與公平的統(tǒng)一,在此價(jià)值取向指導(dǎo)下,選擇克服困境之路徑,并對(duì)其可行性予以論證；最后,在以上論述的基礎(chǔ)上嘗試性構(gòu)建土地信托財(cái)產(chǎn)體系。
[Abstract]:In the rural land trust system, the rural land trust property is the core of the whole system. When trying to promote the efficient circulation of land rights by commercial trust, how to integrate the theory of property rights reasonably, what is the scope of trust property as the object of the legal relationship of land trust? What are the difficulties in the development of rural land trust theory and practice, what path should be chosen to overcome these difficulties, and whether to construct a perfect rural land trust property system. In the face of the above problems, this paper tries to demonstrate the following ideas: the first part points out the special legal nature of trust property from the concept and connotation of trust property. And thus generalize the nature of the right can be transferred in trust. On this basis, the basic issues related to trust property in the transfer process of rural land rights by trust are expounded, which lays the foundation for the subsequent discussion. Secondly, the related policies, laws and regulations of rural land trust are sorted out. Combined with the present land trust practice, we can see that the land trust property has a single type, the independence has not been paid enough attention to, the publicity system is not perfect, and so on; thirdly, to overcome the development dilemma, its value orientation should be the unity of efficiency and fairness. Under the guidance of this value orientation, choose the way to overcome the predicament, and demonstrate its feasibility; finally, on the basis of the above discussion, try to build the land trust property system.
