【摘要】：自貿(mào)協(xié)定中文化產(chǎn)業(yè)領域的外資準入清單設置具有多樣化和復雜性的特點。文章利用比較法的研究方法,針對當前文化產(chǎn)業(yè)較發(fā)達的國家締結的自貿(mào)協(xié)定中相關清單的模式加以研究,并對我國相關清單的設置提出建議。此類清單主要有正面清單和負面清單兩種模式,采用負面清單的國家又存在多種變通方法以維護本國文化利益。我國應當借鑒先進國際經(jīng)驗,在形式上設置"減碼"和"加碼"清單,分別將禁止類和限制類的產(chǎn)業(yè)門類納入其中,采用通行的產(chǎn)業(yè)分類標準,提升清單透明度,靈活地設置負面清單的條款和內(nèi)容。
[Abstract]:Foreign access list from the field of cultural industry trade agreement set has the characteristics of diversity and complexity. By using the method of comparison, according to the study of the relevant FTA in the list of current cultural industries in developed countries concluded the model, and puts forward proposals on China's list of related settings. This list include positive negative list and the list of two models, the negative list of countries and to safeguard national cultural interests a variety of workaround. China should learn from advanced international experience, in the form of "reduction" and "add code" list, respectively, will be prohibited and restricted industries included, by industry classification standard, improve inventory transparency, flexibility to set up a negative list of terms and contents.
