【摘要】：要對(duì)網(wǎng)絡(luò)專(zhuān)車(chē)進(jìn)行有效監(jiān)管,前提是明確專(zhuān)車(chē)平臺(tái)的運(yùn)輸服務(wù)性質(zhì)。在分別從專(zhuān)車(chē)的交易性質(zhì)、運(yùn)行特征、法律責(zé)任等方面探討專(zhuān)車(chē)服務(wù)性質(zhì)和監(jiān)管影響的基礎(chǔ)上,明確了專(zhuān)車(chē)平臺(tái)不是信息中介,而是在提供運(yùn)輸服務(wù),并從法律角度得出專(zhuān)車(chē)現(xiàn)有的契約形式安排是監(jiān)管套利的結(jié)論。最后結(jié)合國(guó)際主流做法,從社會(huì)法治、行業(yè)利益角度提出了政府部門(mén)盡快按運(yùn)輸服務(wù)建立專(zhuān)車(chē)監(jiān)管體系的必要性。
[Abstract]:The premise of the effective supervision of the network car is to make clear the nature of the transport service of the special vehicle platform. On the basis of discussing the nature of the special bus service and the influence of supervision from the aspects of the transaction nature, operation characteristics and legal liability of the special car, it is clear that the special car platform is not an information intermediary, but is providing transportation services. And from the legal point of view, the existing contract arrangement is the conclusion of regulatory arbitrage. Finally, combined with the international mainstream practice, from the point of view of the social rule of law and the interests of the industry, the necessity for government departments to establish a special car supervision system according to transport services as soon as possible is put forward.
