【摘要】:近年來(lái),隨著沿江經(jīng)濟(jì)的迅速發(fā)展,尤其石油、化工、天然氣、能源等產(chǎn)業(yè)的飛速發(fā)展,經(jīng)由長(zhǎng)江干線運(yùn)輸?shù)奈kU(xiǎn)品量持續(xù)增加,危險(xiǎn)品運(yùn)輸船舶和危險(xiǎn)品裝卸碼頭數(shù)量也在增加。危險(xiǎn)品水路運(yùn)輸具有運(yùn)量大、種類多、特性復(fù)雜等特點(diǎn),一旦發(fā)生交通事故或污染事故,擴(kuò)散迅速,難以控制,影響范圍很廣,事故的應(yīng)急救助和污染物的清除都十分困難,破壞性很大。海事管理機(jī)構(gòu)作為水路危險(xiǎn)品運(yùn)輸?shù)墓芾頇C(jī)構(gòu)之一,在保障船舶航行安全、防治水域污染和事故應(yīng)急救助等方面責(zé)任重大。但實(shí)際上,我國(guó)海事管理工作仍存在不少問(wèn)題,影響了危險(xiǎn)品運(yùn)輸安全和水域污染防治,因此,解決存在的問(wèn)題,提高危險(xiǎn)品運(yùn)輸海事監(jiān)管水平是很有必要的。本文的研究方向是長(zhǎng)江海事管理機(jī)構(gòu)對(duì)長(zhǎng)江干線危險(xiǎn)品運(yùn)輸?shù)谋O(jiān)管。運(yùn)用文獻(xiàn)研究法、調(diào)查法和定性分析法開展研究。通過(guò)對(duì)長(zhǎng)江干線危險(xiǎn)品運(yùn)輸現(xiàn)狀、危險(xiǎn)品事故現(xiàn)狀和海事監(jiān)管現(xiàn)狀進(jìn)行深入調(diào)查和認(rèn)真研究,分析當(dāng)前危險(xiǎn)品運(yùn)輸海事監(jiān)管模式,梳理海事機(jī)構(gòu)在危險(xiǎn)品運(yùn)輸管理中的職責(zé),查找長(zhǎng)江干線危險(xiǎn)品運(yùn)輸中海事監(jiān)管存在的問(wèn)題。結(jié)合國(guó)外發(fā)達(dá)國(guó)家水路危險(xiǎn)品運(yùn)輸監(jiān)管概況,借鑒先進(jìn)經(jīng)驗(yàn),進(jìn)而在推動(dòng)完善危險(xiǎn)品運(yùn)輸管理法律法規(guī),改進(jìn)長(zhǎng)江海事機(jī)構(gòu)在危險(xiǎn)品水路運(yùn)輸中的管理方式等方面提出合理化建議。本文共分7個(gè)部分。第1部門是緒論部分,介紹研究背景、目的及意義,結(jié)合水路危險(xiǎn)品運(yùn)輸國(guó)內(nèi)外研究現(xiàn)狀,確立研究思路和研究方法,制定技術(shù)路線。第2部分是相關(guān)概念和理論介紹,重點(diǎn)介紹了長(zhǎng)江干線、危險(xiǎn)品運(yùn)輸、海事監(jiān)管三個(gè)概念,并對(duì)應(yīng)急管理理論與政府規(guī)制理論進(jìn)行了系統(tǒng)闡述。第3部分是通過(guò)長(zhǎng)江干線危險(xiǎn)品運(yùn)輸現(xiàn)狀和事故特點(diǎn)進(jìn)行分析,找出影響長(zhǎng)江干線危險(xiǎn)品運(yùn)輸安全的因素。第4部分是對(duì)長(zhǎng)江海事監(jiān)管現(xiàn)狀進(jìn)行深入分析研究,查找危險(xiǎn)品運(yùn)輸監(jiān)管中存在的問(wèn)題。第5部分是介紹國(guó)外一些發(fā)達(dá)國(guó)家的海事監(jiān)管概況,找尋值得學(xué)習(xí)借鑒之處。第6部分是對(duì)提高長(zhǎng)江干線危險(xiǎn)品海事監(jiān)管水平,促進(jìn)危險(xiǎn)品運(yùn)輸安全的提出研究對(duì)策。第7部分是全文總結(jié)。本文運(yùn)用公共管理學(xué)中政府規(guī)制理論和應(yīng)急管理理論,立足長(zhǎng)江危險(xiǎn)品運(yùn)輸實(shí)際,探索有效的長(zhǎng)江危險(xiǎn)品海事監(jiān)管策略,根本目的是保障長(zhǎng)江干線危險(xiǎn)品運(yùn)輸安全,防治水域污染,服務(wù)長(zhǎng)江經(jīng)濟(jì)帶建設(shè)國(guó)家戰(zhàn)略。
[Abstract]:In recent years, with the rapid development of the economy along the Yangtze River, especially the rapid development of petroleum, chemical, natural gas and energy industries, the quantity of dangerous goods transported through the Yangtze River trunk line continues to increase. The number of dangerous goods shipping vessels and dangerous goods handling terminals is also increasing. The waterway transportation of dangerous goods has the characteristics of large quantity, variety and complex characteristics. Once a traffic accident or pollution accident occurs, it is difficult to control and spread quickly, and has a wide range of influence. It is very difficult to rescue the accident and remove pollutants. It is very destructive. As one of the management organizations of dangerous goods transportation by sea, the maritime management agency is responsible for ensuring the safety of navigation, preventing and curing water pollution and accident emergency rescue and so on. However, in fact, there are still many problems in the maritime management of our country, which affect the safety of dangerous goods transportation and the prevention of water pollution. Therefore, it is necessary to solve the existing problems and improve the level of maritime supervision of dangerous goods transportation. The research direction of this paper is the supervision of the Yangtze River Maritime Administration on the transport of dangerous goods along the Yangtze River. Literature research method, investigation method and qualitative analysis method are used to carry out the research. Through the in-depth investigation and careful study on the status quo of dangerous goods transportation, dangerous goods accidents and maritime supervision in the Yangtze River trunk line, this paper analyzes the current maritime supervision mode of dangerous goods transportation, and combs the responsibilities of maritime organizations in the management of dangerous goods transportation. Find out the problems existing in maritime supervision in the transport of dangerous goods along the Yangtze River. Combining with the supervision and control of dangerous goods transportation by waterway in developed countries, and learning from advanced experience, it will promote the improvement of the laws and regulations governing the transport of dangerous goods. To improve the management mode of the Yangtze River maritime organization in dangerous goods transportation by water, some reasonable suggestions are put forward. This paper is divided into seven parts. The first part is the introduction, which introduces the background, purpose and significance of the research, establishes the research ideas and methods, and formulates the technical route in combination with the domestic and international research status of waterway dangerous goods transportation. The second part is the related concepts and theoretical introduction, focusing on the Yangtze River main line, dangerous goods transport, maritime supervision three concepts, and the emergency management theory and the theory of government regulation were systematically expounded. The third part analyzes the current situation and accident characteristics of dangerous goods transportation in the Yangtze River trunk line, and finds out the factors that affect the transportation safety of dangerous goods in the Yangtze River trunk line. The fourth part is to carry on the thorough analysis to the Yangtze River maritime supervision present situation, looks for the dangerous goods transportation supervision to exist the question. The fifth part introduces the maritime supervision in some developed countries. The sixth part is to improve the level of maritime supervision of dangerous goods along the Yangtze River, and to promote the safety of dangerous goods transportation. The seventh part is a summary of the full text. This paper applies the theory of government regulation and emergency management in public management, based on the actual transportation of dangerous goods in the Yangtze River, and explores the effective maritime supervision strategy of dangerous goods in the Yangtze River. The fundamental purpose is to ensure the safety of dangerous goods transportation in the Yangtze River trunk line. To prevent and control water pollution and serve the national strategy for the construction of the Yangtze economic belt.
