【摘要】：道路運輸行政執(zhí)法建設一直以來都是深圳市行政執(zhí)法工作的重要組成部分,改革開放30年以來,深圳市面貌發(fā)生了日新月異的變化,在道路運輸行政管理方面也取得了巨大的成就,深圳市道路運輸市場秩序得到了進一步的規(guī)范。但由于深圳特殊的區(qū)位條件和一些問題的根深蒂固,深圳道路運輸行政執(zhí)法工作仍存在諸多問題,特別是在深圳提出特區(qū)一體化建設方案之后,要打破多年來形成的道路運輸行政執(zhí)法“一分為二”的管理格局實屬不易。因此,如何更好地開展道路行政執(zhí)法工作,以推動深圳道路運輸行業(yè)發(fā)展的問題,引起了公共管理研究人員的普遍關注。在此背景下,探索道路運輸行政執(zhí)法問題的解決策略與對策,以建立適應深圳特區(qū)一體化新形勢要求的道路運輸行政執(zhí)法工作機制,具有重要的意義。 鑒于此,本研究綜合運用文獻研究法、綜合分析法、案例分析法等研究方法開展研究工作。文章首先具體介紹了相關行政法律法規(guī)和公共行政理論,為全文打下了理論基礎。其次,全面地分析了深圳市道路運輸行政執(zhí)法的現(xiàn)狀,從而引出現(xiàn)階段深圳市道路運輸行政執(zhí)法工作中存在的問題及其原因,主要有：①道路行政法律法規(guī)的適用存在爭議,規(guī)章條例的制定不盡完善；②道路執(zhí)法工作管理機制不健全,導致非法營運行為猖獗,行政執(zhí)法效率不高：③行政管理隊伍建設尚有缺陷,行政執(zhí)法人員的執(zhí)法素養(yǎng)不高；④行政執(zhí)法工作還存在一些空白點,如特殊車輛監(jiān)管無門；⑤深圳市現(xiàn)行道路運輸執(zhí)法建設難以適應特區(qū)一體化發(fā)展的需要等。最后,借鑒國內(nèi)外道路運輸行政執(zhí)法的模式及經(jīng)驗,并結(jié)合深圳道路運輸行政執(zhí)法實際情況,以適應深圳特區(qū)一體化新形勢要求為目標,以建立行政責任體系為主線,提出了一系列完善道路運輸行政執(zhí)法工作機制的具體措施和建議,主要包括：①推動相關法律法規(guī)修改完善,為提高執(zhí)法工作水平和效率提供科學依據(jù)和強力保障；②建立健全長效工作機制,構(gòu)建現(xiàn)代化高效行政管理體系；③加強執(zhí)法隊伍自身建設,進一步充實執(zhí)法力量；④創(chuàng)新執(zhí)法工作形式與手段,提升執(zhí)法能力與水平：⑤實施多管齊下綜合管理,全面加強運政執(zhí)法工作成效,以期能夠為深圳市建立完善的道路運輸行政執(zhí)法工作機制提供有益參考。
[Abstract]:The construction of road transport administrative law enforcement has always been an important part of the administrative law enforcement work in Shenzhen. Since the reform and opening up to the outside world, Shenzhen has changed with each passing day over the past 30 years. Great achievements have been made in the administration of road transportation, and the order of road transportation market in Shenzhen has been further standardized. However, due to Shenzhen's special location conditions and deep-rooted problems, there are still many problems in Shenzhen's road transport administrative law enforcement work, especially after Shenzhen put forward a plan for the integration of the Special Zone. It is not easy to break up the administrative law enforcement pattern of road transportation. Therefore, how to better carry out the law enforcement work of road administration in order to promote the development of road transport industry in Shenzhen has aroused the general concern of public management researchers. Under this background, it is of great significance to explore the strategies and countermeasures to solve the problems of road transport administrative law enforcement, so as to establish a working mechanism of road transport administrative law enforcement to meet the requirements of the new situation of integration of Shenzhen Special Economic Zone. In view of this, this research uses the literature research method, the comprehensive analysis method, the case analysis method to carry on the research work comprehensively. The article first introduces the relevant administrative laws and regulations and the theory of public administration, which lays a theoretical foundation for the full text. Secondly, this paper comprehensively analyzes the present situation of road transport administrative law enforcement in Shenzhen, which leads to the existing problems and reasons in the administrative law enforcement of road transport in Shenzhen at the present stage. There are mainly disputes over the application of the road administrative laws and regulations of 1: 1. The establishment of rules and regulations is not perfect and the management mechanism of road law enforcement work is not perfect, which leads to the rampant illegal operation, the low efficiency of administrative law enforcement and the defect of the construction of administrative management team, and the imperfection of administrative law enforcement personnel's quality of law enforcement; (4) there are still some blank spots in administrative law enforcement, such as special vehicle supervision without doors. 5. The current road transport law enforcement construction in Shenzhen is difficult to meet the needs of the integration development of the special zone and so on. Finally, draw lessons from the mode and experience of road transport administrative law enforcement at home and abroad, and combine the actual situation of Shenzhen road transport administrative law enforcement with the goal of adapting to the requirements of the new situation of Shenzhen Special Economic Zone integration, and take the establishment of administrative responsibility system as the main line. This paper puts forward a series of concrete measures and suggestions to perfect the mechanism of road transport administrative law enforcement, including: 1) to promote the revision and perfection of relevant laws and regulations, and to provide scientific basis and strong guarantee for improving the level and efficiency of law enforcement; (2) establishing and perfecting the long-term working mechanism, constructing modern and efficient administrative management system and strengthening the self-construction of the law enforcement team, further enriching the law enforcement forces and innovating the forms and means of the law enforcement work; To improve the ability and level of law enforcement: 5 to carry out multi-pronged and integrated management, and to strengthen the effectiveness of law enforcement of transportation and administration in an all-round way, in order to provide a useful reference for the establishment of a perfect mechanism of road transport administrative law enforcement in Shenzhen.
