【摘要】：隨著我國(guó)城市化水平的不斷提高，地鐵在緩解城市交通壓力和疏散城區(qū)人口等方面所起的作用日益凸顯。西安市地鐵開(kāi)通一年來(lái)，對(duì)豐富人們的出行方式做出了不少貢獻(xiàn)，但也出現(xiàn)了規(guī)制機(jī)構(gòu)職責(zé)不清，票價(jià)機(jī)制調(diào)整機(jī)制不健全，服務(wù)質(zhì)量監(jiān)管不到位，法律框架不完善等一系列問(wèn)題，，加強(qiáng)政府規(guī)制勢(shì)在必行。 本文在對(duì)國(guó)內(nèi)外的文獻(xiàn)進(jìn)行詳細(xì)總結(jié)的基礎(chǔ)上，通過(guò)分析地鐵的準(zhǔn)公共物品屬性、自然壟斷屬性、公益性、外部性等方面，指出了地鐵行業(yè)政府規(guī)制的必要性。并進(jìn)一步對(duì)進(jìn)入規(guī)制、價(jià)格規(guī)制、質(zhì)量規(guī)制等規(guī)制內(nèi)容進(jìn)行了分析介紹。然后對(duì)西安市地鐵規(guī)劃發(fā)展、規(guī)制機(jī)構(gòu)、票價(jià)票制的現(xiàn)狀及政府規(guī)制中普遍存在的問(wèn)題和原因進(jìn)行了簡(jiǎn)單的分析。通過(guò)對(duì)巴黎、倫敦和新加坡三國(guó)地鐵規(guī)制的詳細(xì)分析，得出了對(duì)西安市地鐵行業(yè)進(jìn)行政府規(guī)制的經(jīng)驗(yàn)借鑒：建立獨(dú)立的規(guī)制機(jī)構(gòu)，健全法律法規(guī)、完善監(jiān)督手段。 針對(duì)西安市地鐵存在的問(wèn)題，提出了政府規(guī)制的政策建議：應(yīng)組建獨(dú)立的規(guī)制機(jī)構(gòu)，真正形成政企合作、權(quán)責(zé)明晰的經(jīng)營(yíng)管理模式；應(yīng)建立健全相應(yīng)的法律法規(guī)，保證規(guī)制過(guò)程有法可依；完善票價(jià)制定與調(diào)整機(jī)制，做到公益優(yōu)先兼顧效益；加強(qiáng)社會(huì)組織力量、公眾力量、輿論力量對(duì)規(guī)制機(jī)構(gòu)的監(jiān)督，建立完善的外部監(jiān)督體系。
[Abstract]:With the development of urbanization in China, subway plays an increasingly important role in relieving traffic pressure and evacuating urban population. Since the opening of the Xi'an subway a year ago, it has made a lot of contributions to enriching people's travel mode, but it has also appeared that the responsibilities of the regulatory bodies are unclear, the mechanism for adjusting fares is not perfect, and the supervision of service quality is not in place. A series of problems, such as imperfect legal framework, make it imperative to strengthen government regulation. On the basis of a detailed summary of the literature at home and abroad, this paper points out the necessity of government regulation in subway industry by analyzing the attributes of quasi-public goods, natural monopoly, public welfare, externality, and so on. Furthermore, the contents of entry regulation, price regulation and quality regulation are analyzed and introduced. Then the paper analyzes the current situation of Xi'an subway planning and development, regulatory agencies, ticket system and the problems and reasons in government regulation. Based on the detailed analysis of the subway regulation in Paris, London and Singapore, the author draws the lessons from the government regulation of Xi'an subway industry: establishing independent regulatory agencies, perfecting laws and regulations, and perfecting supervision means. In view of the existing problems of subway in Xi'an city, this paper puts forward the policy suggestions of government regulation: to set up an independent regulatory body, to truly form a management mode of cooperation between government and enterprise, to establish and perfect the corresponding laws and regulations, and to establish and perfect the relevant laws and regulations. To ensure that the regulatory process has laws; to improve the pricing and adjustment mechanism, so as to give priority to the benefit of public welfare; to strengthen the social organization force, public power, public opinion force to supervise the regulatory agencies, establish a sound external supervision system.
