經(jīng)天津出口鐵路貨物物權(quán)轉(zhuǎn)移中的風(fēng)險(xiǎn)控制

【摘要】:自2008年國(guó)際金融危機(jī)以來(lái),中國(guó)的進(jìn)出口貿(mào)易量一直處于低增長(zhǎng)或減弱的狀況,美國(guó)以及歐洲的經(jīng)濟(jì)一直沒(méi)有實(shí)現(xiàn)真正的復(fù)蘇,國(guó)際貿(mào)易海上運(yùn)輸已經(jīng)發(fā)展到一定的瓶頸期。與此同時(shí)我國(guó)同接壤的鄰國(guó)經(jīng)濟(jì)一直是隱藏在歐美經(jīng)濟(jì)之下的不被關(guān)注的地帶,然而這些經(jīng)濟(jì)體與中國(guó)之間的貿(mào)易卻存在在巨大的潛力,我國(guó)同俄羅斯、蒙古、中亞諸國(guó)、朝鮮、越南等國(guó)家的貿(mào)易大多通過(guò)汽車或火車運(yùn)輸,諸如俄羅斯、蒙古、中亞國(guó)家甚至歐洲國(guó)家如果選擇鐵路運(yùn)輸,會(huì)比汽車運(yùn)輸節(jié)省更多的時(shí)間和費(fèi)用。 本文主要通過(guò)研究國(guó)際貿(mào)易海上運(yùn)輸對(duì)于物權(quán)轉(zhuǎn)移及風(fēng)險(xiǎn)的控制理論,結(jié)合國(guó)際貿(mào)易鐵路運(yùn)輸自身的特點(diǎn),通過(guò)理論聯(lián)系實(shí)際的方法,提出現(xiàn)行國(guó)際貿(mào)易鐵路運(yùn)輸在物權(quán)轉(zhuǎn)移過(guò)程中存在的風(fēng)險(xiǎn)隱患,并對(duì)此隱患提出作者的意見(jiàn),從而達(dá)到推動(dòng)國(guó)際貿(mào)易鐵路運(yùn)輸?shù)陌l(fā)展的目的。 基于此,本篇論文從五個(gè)方面進(jìn)行闡述,第一部分是緒論,介紹了本文的背景和意義,內(nèi)容與方法以及國(guó)內(nèi)外學(xué)者對(duì)于此項(xiàng)問(wèn)題的研究成果。第二部分是相關(guān)理論概述,主要介紹了國(guó)際貿(mào)易鐵路運(yùn)輸?shù)幕靖拍、物?quán)的概念以及物權(quán)在國(guó)際貿(mào)易中的重要性,為文章的寫作奠定理論基礎(chǔ),確保論文研究的切實(shí)性。第三部分重點(diǎn)闡述了國(guó)際貿(mào)易海上運(yùn)輸貨物在物權(quán)轉(zhuǎn)移中的風(fēng)險(xiǎn)控制措施,國(guó)際貿(mào)易術(shù)語(yǔ)的應(yīng)用對(duì)于風(fēng)險(xiǎn)控制的作用,、以及海運(yùn)提單作為物權(quán)憑證對(duì)于收發(fā)貨人在國(guó)際貿(mào)易中的平等地位等,為下一部分提出的國(guó)際貿(mào)易鐵路運(yùn)輸在物權(quán)轉(zhuǎn)移中存在的風(fēng)險(xiǎn)規(guī)避提供了理論支持和借鑒作用。第四部分介紹了國(guó)際貿(mào)易鐵路運(yùn)輸貨物在操作流程,以及在國(guó)際貿(mào)易各種成交方式中物權(quán)在何時(shí)轉(zhuǎn)移,在轉(zhuǎn)移點(diǎn)上收發(fā)貨人各自面臨的風(fēng)險(xiǎn)等,并提出了作者對(duì)于國(guó)際貿(mào)易鐵路運(yùn)輸中存在的風(fēng)險(xiǎn)隱患,為下一步提出解決方法奠定了基礎(chǔ)。第五部分是本篇論文的重點(diǎn),通過(guò)前幾部分的梳理,已經(jīng)對(duì)于國(guó)際貿(mào)易鐵路運(yùn)輸物權(quán)轉(zhuǎn)移過(guò)程中存在的風(fēng)險(xiǎn)提出了問(wèn)題,出口信用保險(xiǎn)的推廣等幾方面,充分保障了鐵路運(yùn)輸中收發(fā)貨人的權(quán)益和利益。通過(guò)以上的制度和實(shí)際操作中的風(fēng)險(xiǎn)規(guī)避,盡可能的保障了國(guó)際貿(mào)易鐵路運(yùn)輸?shù)陌l(fā)展,達(dá)到了中國(guó)與接壤的鄰國(guó)以及通過(guò)歐亞大陸橋方式進(jìn)行貿(mào)易的其他國(guó)家的貿(mào)易進(jìn)行推動(dòng)的目的。文章最后是結(jié)論,對(duì)本文的論述進(jìn)行了總結(jié),也對(duì)于今后的鐵路貿(mào)易進(jìn)行了展望。
[Abstract]:Since the international financial crisis in 2008, China's import and export trade has been in a situation of low growth or weakening, the economy of the United States and Europe has not realized a real recovery, international trade and maritime transport has developed to a certain bottleneck period. At the same time, the economies of our neighboring countries have always been hidden under the economies of Europe and the United States, but there is great potential for trade between these economies and China, with Russia, Mongolia, and the Central Asian countries. North Korea, Vietnam and other countries trade mostly by car or rail, such as Russia, Mongolia, Central Asian countries and even European countries if they choose rail transport, it will save more time and cost than automobile transport. This article mainly through the research international trade sea transportation to the real right transfer and the risk control theory, unifies the international trade railroad transportation own characteristic, through the theory unifies the actual method, This paper puts forward the hidden risks existing in the transfer of real rights in the current international trade and railway transportation, and puts forward the author's opinions on the hidden dangers, so as to achieve the purpose of promoting the development of international trade and railway transport. The first part is the introduction, which introduces the background, significance, content and methods of this paper and the research results of domestic and foreign scholars on this issue. The second part is an overview of relevant theories, which mainly introduces the basic concepts of international trade and railway transportation, the concept of real right and the importance of real right in international trade, which lays a theoretical foundation for the writing of the article and ensures the practicality of the research. The third part focuses on the risk control measures of goods transported by sea in international trade in the transfer of real right. The role of the application of international trade terms in risk control, and the equal status of maritime bills of lading as documents of title for consignee and consignee in international trade, It provides theoretical support and reference for the risk aversion of international trade railway transportation in the transfer of real right. The fourth part introduces the operation process of international trade and railway transport goods, as well as when the real right is transferred in various ways of international trade, and the risks faced by the consignee and consignee at the transfer point, etc. The author also puts forward the hidden risks in the international trade and railway transportation, which lays a foundation for the next step. The fifth part is the focal point of this paper, through the combing of the first several parts, has raised the question to the risk existing in the process of the transfer of the real right of the international trade and railway transportation, the promotion of the export credit insurance and so on. Fully protect the rights and interests of consignors and consignors in railway transportation. Through the above system and the practical operation of risk avoidance, as far as possible to ensure the development of international trade and rail transport, It has achieved the purpose of promoting trade between China and its neighboring countries and other countries that trade through the Eurasian Continental Bridge. At the end of the article, the conclusion is given, the discussion of this paper is summarized, and the future of railway trade is also prospected.
