我國民航業(yè)政府規(guī)制改革研究

【摘要】:我國民航業(yè)政府規(guī)制改革,關(guān)系到我國千萬百姓能否維護(hù)其切身利益,關(guān)系到眾多民航企業(yè)能否維持其可持續(xù)發(fā)展,也關(guān)系到我國民航強國戰(zhàn)略能否實現(xiàn)其宏偉目標(biāo)。本文歸納了我國民航業(yè)政府規(guī)制改革當(dāng)前所面臨的問題,并在結(jié)合我國民航實際航情與國際民航規(guī)制改革經(jīng)驗的基礎(chǔ)上,對我國民航業(yè)政府規(guī)制改革提出了的幾點建議和對策。 在充分收集相關(guān)資料的基礎(chǔ)上,筆者首先厘清了民航規(guī)制改革的理論基礎(chǔ),清晰地對民航業(yè)規(guī)制改革的四大領(lǐng)域進(jìn)行理論剖析,并明確闡明了四大規(guī)制理論在我國民航業(yè)中的運用。其次在分析民航規(guī)制改革動因的基礎(chǔ)上,,梳理了我國民航業(yè)政府規(guī)制改革已經(jīng)走過的五個階段,并依據(jù)改革的現(xiàn)狀提出了我國民航業(yè)政府規(guī)制改革所面臨的四大問題。再次,筆者帶著問題,選取美國、英國和日本這三個各具民航業(yè)政府規(guī)制改革特色的國家,對他們的民航政府規(guī)制改革實踐進(jìn)行總結(jié),并歸納出對我國民航政府規(guī)制改革有啟發(fā)作用的國際經(jīng)驗。最后,筆者有針對性的提出我國民航業(yè)政府規(guī)制改革的四大對策和建議:第一,正確定位我國民航四大規(guī)制對象的市場性質(zhì)——壟斷性與競爭性并存,并依據(jù)此提出我國民航政府規(guī)制改革的方向——再規(guī)制與放松規(guī)制并存;第二,我國民航業(yè)必須徹底實現(xiàn)“政企規(guī)范”,并正確界定我國民航規(guī)制主體的規(guī)制職能;第三,進(jìn)一步建設(shè)和完善與我國民航政府規(guī)制改革相配套監(jiān)督體系;第四,強化我國民航規(guī)制法律體系的建設(shè),為我國民航政府規(guī)制改革提供良好的法律環(huán)境和法律保障。
[Abstract]:The government regulation reform of China's civil aviation industry is related to whether our country can safeguard its vital interests, whether many civil aviation enterprises can maintain its sustainable development, and whether our civil aviation power strategy can realize its grand goal. This paper summarizes the problems faced by the government regulation reform of China's civil aviation industry, and puts forward some suggestions and countermeasures for the government regulation reform of China's civil aviation industry on the basis of combining the actual aviation situation of our country and the experience of the international civil aviation regulation reform. Based on the full collection of relevant information, the author firstly clarifies the theoretical basis of civil aviation regulation reform, and makes a clear theoretical analysis of the four major areas of civil aviation regulation reform. The application of four regulation theories in China's civil aviation industry is clarified. Secondly, on the basis of analyzing the causes of civil aviation regulation reform, this paper combs the five stages that the civil aviation industry government regulation reform has gone through, and puts forward the four major problems faced by the civil aviation industry government regulation reform according to the current situation of the reform. Third, with the question, the author selects the United States, Britain and Japan, each of the civil aviation industry government regulation reform characteristics of the three countries, to their civil aviation government regulation reform practice summarized. It also sums up the international experience that can enlighten the civil aviation government regulation reform of our country. Finally, the author puts forward four countermeasures and suggestions for the government regulation reform of China's civil aviation industry: first, correctly positioning the market nature of the four major regulatory objects of China's civil aviation industry-monopoly and competitiveness. Based on this, the author puts forward the direction of civil aviation government regulation reform in China-re-regulation and deregulation coexist; second, China's civil aviation industry must thoroughly realize the "government and enterprise norms", and correctly define the regulation function of civil aviation regulation subjects in China; third, Further construction and improvement of China's civil aviation government regulation reform supporting the supervision system; fourth, strengthen China's civil aviation regulation legal system construction, for China's civil aviation government regulation reform to provide a good legal environment and legal protection.
