【摘要】：公路建設(shè)是國民經(jīng)濟(jì)的重要組成部分，對促進(jìn)和帶動(dòng)社會(huì)經(jīng)濟(jì)的持續(xù)、快速、健康發(fā)展至關(guān)重要，公路在整個(gè)社會(huì)和經(jīng)濟(jì)發(fā)展中具有不可替代的支撐作用。公路已逐步形成多元投資主體共同投資的新格局，，加強(qiáng)公路建設(shè)資金的監(jiān)督管理，保證資金安全、合理有效使用，對促進(jìn)公路事業(yè)的健康發(fā)展具有重要意義。眾多學(xué)者從公路建設(shè)資金監(jiān)管長效機(jī)制、投融資監(jiān)管和基本建設(shè)程序中監(jiān)管等多個(gè)角度進(jìn)行了比較詳盡的研究。然而，從這三個(gè)角度綜合分析公路建設(shè)資金監(jiān)管問題的研究較為少見。 為此，本文以政府監(jiān)管理論為基礎(chǔ)，對發(fā)達(dá)國家公路基本建設(shè)資金監(jiān)管運(yùn)行現(xiàn)狀進(jìn)行研究，分析出其有益經(jīng)驗(yàn)以資借鑒；同時(shí)，提出我國公路基本建設(shè)資金監(jiān)管存在的問題，并對其形成原因進(jìn)行分析。最后，針對問題和形成原因，并借鑒國外的經(jīng)驗(yàn)，提出改善我國公路基本建設(shè)資金監(jiān)管的切實(shí)可行措施。本文主要結(jié)論如下： 首先，通過建立和完善公路建設(shè)資金監(jiān)管法律法規(guī)體系，同時(shí)，逐步完善公路建設(shè)投資管理體制來完善公路建設(shè)資金監(jiān)管機(jī)制。其次，通過完善收費(fèi)公路權(quán)益轉(zhuǎn)讓法律法規(guī)和建立BOT的法律法規(guī)等監(jiān)管體系建立和完善公路建設(shè)資金投融資監(jiān)管。最后，通過完善建設(shè)投資決策、嚴(yán)格執(zhí)行招投標(biāo)、嚴(yán)格勘察設(shè)計(jì)程序、嚴(yán)格執(zhí)行基本建設(shè)程序、加強(qiáng)建設(shè)單位管理費(fèi)的監(jiān)管、加強(qiáng)資產(chǎn)移交的執(zhí)行等環(huán)節(jié)的監(jiān)管基本建設(shè)程序。
[Abstract]:Highway construction is an important part of the national economy. It is very important to promote and promote the sustained, rapid and healthy development of social economy. The highway plays an irreplaceable supporting role in the whole social and economic development. Highway has gradually formed a new pattern of joint investment by multiple investors. It is of great significance to strengthen the supervision and management of highway construction funds, to ensure the safety and rational use of funds, and to promote the healthy development of highway undertakings. Many scholars have carried on the detailed research from many angles, such as the long-term mechanism of highway construction fund supervision, the supervision of investment and financing and the supervision of capital construction procedure. However, it is rare to analyze the supervision of highway construction funds from these three angles. Therefore, based on the theory of government supervision, this paper studies the operation status of highway capital construction fund supervision in developed countries, and analyzes its beneficial experience for reference, at the same time, it puts forward the problems existing in the supervision of highway capital construction fund in China. The causes of its formation are analyzed. Finally, aiming at the problems and forming reasons, and drawing on the experience of foreign countries, the paper puts forward some practical measures to improve the supervision of the capital of highway capital construction in our country. The main conclusions are as follows: First of all, through the establishment and improvement of highway construction funds supervision laws and regulations system, at the same time, gradually improve the highway construction investment management system to improve the highway construction funds supervision mechanism. Secondly, we should establish and perfect the supervision system of highway construction fund investment and financing by perfecting the laws and regulations of the transfer of toll road rights and regulations and establishing the laws and regulations of BOT. Finally, through perfecting the construction investment decision, strictly carrying out bidding, strictly investigating and designing procedure, strictly carrying out the procedure of capital construction, strengthening the supervision of management fee of construction unit, strengthening the procedure of supervising capital construction in such links as the execution of transfer of assets, etc.
