【摘要】:隨著人們生活水平提高和城市交通發(fā)展,老百姓出行需要越來越高,盡管大部分城市具有完備公交、出租車系統(tǒng),甚至還有地鐵,但是出行難、難打車一直是城市通勤的通病。網(wǎng)絡(luò)預(yù)約出租汽車(以下簡稱網(wǎng)約車)解決出租車空駛率高,乘客與司機(jī)之間信息不對稱的矛盾,大大提高了民眾出行效率。網(wǎng)約車作為新生事物,它的出現(xiàn)也引發(fā)很多問題:打車軟件平臺公司之間互相惡意競爭,大量黑車、私家車加入這個(gè)營運(yùn)行業(yè),出租車司機(jī)罷工事件頻發(fā),城市交通事故發(fā)生率提高,乘客合理權(quán)益受到侵害等等。政府在現(xiàn)有法律框架下,通過制定規(guī)制,規(guī)范行業(yè)發(fā)展,滿足市民多樣化出行需要,但是政府規(guī)制也有不足之處。文章從網(wǎng)約車性質(zhì)定位、價(jià)格調(diào)控、準(zhǔn)入條件、相關(guān)主體權(quán)益保障等方面分析了網(wǎng)絡(luò)預(yù)約出租汽車政府規(guī)制現(xiàn)狀,從主體責(zé)任、立法保障、人才供給、社會參與等方面分析了其存在的問題及原因,最后針對這些問題提出了相應(yīng)的解決思路。本文以網(wǎng)絡(luò)預(yù)約出租汽車政府規(guī)制為研究對象。首先介紹了城市公共交通狀況,綜述國內(nèi)外研究網(wǎng)絡(luò)預(yù)約出租汽車和傳統(tǒng)出租車情況,同時(shí)對“互聯(lián)網(wǎng)+”、網(wǎng)絡(luò)預(yù)約出租汽車等核心概念進(jìn)行界定,并對公共物品理論、政府規(guī)制理論、參與式治理理論進(jìn)行闡述。其次,文章參考出租汽車管理者、從業(yè)者和交通專家、學(xué)者的意見,運(yùn)用公共管理、公共經(jīng)濟(jì)學(xué)等相關(guān)知識,詳細(xì)介紹網(wǎng)絡(luò)預(yù)約出租汽車發(fā)展過程及其政府規(guī)制現(xiàn)狀兩大部分內(nèi)容:描述了網(wǎng)絡(luò)預(yù)約出租汽車由來、特點(diǎn)與優(yōu)勢、發(fā)展趨勢等三個(gè)方面;從性質(zhì)定位、準(zhǔn)入門檻、價(jià)格調(diào)節(jié)機(jī)制、顧客權(quán)益保障體系、相關(guān)主體之間權(quán)益關(guān)系等五個(gè)方面介紹了網(wǎng)絡(luò)預(yù)約出租汽車政府規(guī)制現(xiàn)狀。再次,文章從主體責(zé)任、立法保障、人才供給、社會參與等四方面分析網(wǎng)絡(luò)預(yù)約出租汽車政府規(guī)制存在問題及其原因。最后,論文針對以上問題提出了完善網(wǎng)絡(luò)預(yù)約出租汽車政府規(guī)制相應(yīng)四點(diǎn)對策:進(jìn)一步明確網(wǎng)絡(luò)預(yù)約出租汽車營運(yùn)中各主體責(zé)任;完善網(wǎng)絡(luò)預(yù)約出租汽車規(guī)制的相關(guān)法規(guī);加強(qiáng)網(wǎng)絡(luò)預(yù)約出租汽車規(guī)制人才培養(yǎng);建立多元主體參與的網(wǎng)絡(luò)預(yù)約出租汽車規(guī)制。
[Abstract]:With the improvement of people's living standard and the development of urban transportation, people need to travel more and more. Although most cities have complete public transportation, taxi system, and even subway, it is difficult to travel and it is always difficult to commute by taxi. The network booking taxi (hereinafter referred to as "network taxi") solves the contradiction of high taxi empty driving rate and asymmetric information between passengers and drivers, which greatly improves the public travel efficiency. As a new thing, there are many problems caused by the emergence of ride-hailing software platform companies: malevolent competition among ride-hailing software platforms, a large number of black cars, private cars joining the operation industry, frequent strikes by taxi drivers, The incidence of urban traffic accidents has increased, the reasonable rights and interests of passengers have been infringed, and so on. Under the existing legal framework, the government regulates the development of the industry and meets the diversified travel needs of citizens, but the government regulation also has some shortcomings. This paper analyzes the current situation of government regulation of network booking taxi from the aspects of the nature, price control, access conditions, rights and interests of related subject, and so on, from the main responsibility, legislative protection, talent supply, etc. This paper analyzes the problems and causes of social participation, and finally puts forward corresponding solutions to these problems. In this paper, the network booking taxi government regulation as the research object. Firstly, this paper introduces the situation of urban public transport, summarizes the domestic and foreign research on online taxi booking and traditional taxi, defines the core concepts of "Internet" and online booking taxi, and gives the theory of public goods. Government regulation theory, participatory governance theory to elaborate. Secondly, the article refers to the opinions of taxi managers, practitioners, transportation experts and scholars, and applies relevant knowledge such as public administration, public economics, etc. This paper introduces in detail the development process and the current situation of government regulation of online booking taxi: it describes the origin, characteristics and advantages, development trend and so on of the online booking taxi, from the nature of positioning, entry threshold, This paper introduces the current situation of government regulation of online booking taxi from five aspects, such as price regulation mechanism, customer rights and interests protection system, and the rights and interests relationship among related subjects. Thirdly, the article analyzes the problems and causes of the government regulation of online taxi booking from four aspects: the main responsibility, the legislative guarantee, the talent supply and the social participation. Finally, the paper puts forward four corresponding countermeasures to improve the government regulation of online booking taxi: further clarifying the responsibilities of the main bodies in the network booking taxi operation, perfecting the relevant laws and regulations of the regulation of the network booking taxi; Strengthen the network booking taxi regulation talent training, and establish multi-subject participation in the network booking taxi regulation.
