網(wǎng)絡治理視域下企沙港水上交通安全監(jiān)管研究

【摘要】:企沙港作為漁商兩用港,港內(nèi)既有漁業(yè)碼頭,又有商業(yè)碼頭,漁船與商船共用進出港航道。在港口水上交通安全監(jiān)管方面,面臨著涉水行政部門多頭管理、管理職能交叉、管理要求不統(tǒng)一等弊端,導致了管理職能落實不到位、行政效率低下,使港內(nèi)缺乏統(tǒng)一有效的進出港調(diào)度及通航管理,船舶之間擦碰、擱淺堵塞航道的情況時有發(fā)生,存在諸多安全隱患。圍繞這些問題,本文通過文獻分析法、對比分析法和案例分析法,對有關(guān)網(wǎng)絡治理及港口水上交通安全監(jiān)管的研究做了概述,對“水上交通安全監(jiān)管”等相關(guān)概念做了界定,簡要介紹了網(wǎng)絡治理理論。通過對照網(wǎng)絡治理理念,對企沙港水上交通安全監(jiān)管現(xiàn)狀與存在問題進行深入剖析,進一步發(fā)現(xiàn)了該水上公共管理難題的根源在于傳統(tǒng)行政管理體制弊病。要解決這個根本性問題,必須圍繞為人民服務宗旨,破除以部門利益為重的官僚制舊觀念,克服傳統(tǒng)政府剛性自閉模式,發(fā)揮網(wǎng)絡治理的優(yōu)點,通力合作、密切配合,整合各涉水執(zhí)法力量,形成水上交通安全監(jiān)管合力,達到1+12的整體效應,發(fā)揮出綜合管理與協(xié)調(diào)管理的優(yōu)勢。 在綜述了美、英、韓三國的水上交通安全監(jiān)管模式,總結(jié)了他們的經(jīng)驗及對我國的啟示后,又介紹了我國沈家門港的管理實踐。最后,通過運用網(wǎng)絡治理理論,針對企沙港現(xiàn)狀,并結(jié)合國內(nèi)外實踐經(jīng)驗,提出由地方政府主導,建立起一個由地方政府、各涉水部門、港航企業(yè)、漁民、碼頭業(yè)主等多方利益代表組成的一個委員會式的協(xié)調(diào)管理機構(gòu),并提出通過地方人大出臺企沙港新港章,既明確規(guī)定港內(nèi)各涉水部門分工及協(xié)作內(nèi)容,又賦予上述協(xié)調(diào)管理機構(gòu)法定名稱、法定地位及職責。在這個前提和框架內(nèi),進一步提出規(guī)范船舶進出港秩序、加強對漁民的宣傳教育以及航道建設養(yǎng)護等有針對性的解決對策,以求全面構(gòu)建企沙港水上交通安全監(jiān)管新模式。
[Abstract]:As a dual-purpose fishing port, there are both fishing wharves and commercial wharves, and fishing vessels share entry and exit channels with merchant ships.In the aspect of port water traffic safety supervision, it is faced with the malpractice of multi-head management, overlapping management functions and inconsistent management requirements, which leads to the lack of implementation of management functions and low administrative efficiency.There is a lack of unified and effective incoming and outgoing dispatch and navigation management in the port, the collision between ships and the blockage of waterway occur from time to time, and there are many hidden dangers in safety.Around these problems, this paper, through literature analysis, comparative analysis and case analysis, summarizes the research on network governance and port water traffic safety supervision, and defines the related concepts, such as "water traffic safety supervision", and so on.This paper briefly introduces the theory of network governance.By comparing with the concept of network management, this paper makes a deep analysis of the present situation and existing problems of water traffic safety supervision in Jieshagang, and further finds out that the root of this water public management problem lies in the shortcomings of the traditional administrative management system.To solve this fundamental problem, we must revolve around the purpose of serving the people, break down the old concept of bureaucratic system, which emphasizes the interests of departments, overcome the rigid self-closing mode of the traditional government, give full play to the advantages of network governance, and cooperate and cooperate closely.Integrating all the law enforcement forces involved in water, forming the joint force of water traffic safety supervision, achieving the overall effect of 112, giving play to the advantages of comprehensive management and coordinated management.After summarizing the water traffic safety supervision modes of America, Britain and Korea, and summarizing their experience and enlightenment to our country, this paper introduces the management practice of Shenjiaokang in China.Finally, through the use of network governance theory, in view of the current situation of the port, and combining the domestic and foreign practical experience, it is proposed that the local government should lead the establishment of a local government, various water departments, port and shipping enterprises, fishermen,A committee of multi-interest representatives such as wharf owners, and the proposal to issue a new port charter for the port through the local people's Congress, which clearly stipulates the division of labor and the contents of cooperation among the various water-related departments in the port,The legal name, legal status and responsibilities of the above-mentioned coordination and management bodies are also given.In this premise and frame, the paper further puts forward the countermeasures of standardizing the order of ships entering and leaving the port, strengthening the propaganda and education of fishermen and the maintenance of waterway construction and so on, in order to build a new mode of water traffic safety supervision in Jieshagang in an all-round way.
