【摘要】：通過對(duì)比分析現(xiàn)有發(fā)達(dá)國家綠色專利快速審查通道項(xiàng)目實(shí)質(zhì)標(biāo)準(zhǔn)和程序要求上的差異性及其優(yōu)缺點(diǎn),提出構(gòu)建一個(gè)申請(qǐng)主題更為寬泛但卻有著實(shí)質(zhì)性環(huán)境益處的審查標(biāo)準(zhǔn),一個(gè)單一發(fā)明只能提交有限獨(dú)立權(quán)利要求和總的權(quán)利要求并且無多個(gè)從屬權(quán)利要求的程序規(guī)則的綠色專利申請(qǐng)快速審查通道,借鑒現(xiàn)有國家推出的專利審批高速公路項(xiàng)目運(yùn)行模式,構(gòu)筑全球綠色專利高速公路,促進(jìn)綠色技術(shù)研發(fā)、實(shí)施和擴(kuò)散。
[Abstract]:By comparing and analyzing the differences in substantive standards and procedural requirements of green patent fast-track projects in developed countries and their merits and demerits, this paper proposes to construct a review standard with a broader application subject but substantial environmental benefits. A single invention can submit only limited independent claims and general claims and no fast-track review of green patent applications without multiple rules of procedure for subordinate claims, Based on the operating mode of patent approval highway project, this paper constructs the global green patent highway, and promotes the research and development, implementation and diffusion of green technology.
