【摘要】:摘要:民航運(yùn)輸業(yè)作為傳統(tǒng)意義上的壟斷行業(yè),其政府管制是目前各國(guó)政府所共同面臨的重大課題,更是我國(guó)政府在接下來(lái)的一段時(shí)期內(nèi)推進(jìn)經(jīng)濟(jì)體制改革的重要任務(wù)。改革開放以來(lái),我國(guó)民航業(yè)快速發(fā)展,行業(yè)規(guī)模不斷擴(kuò)大,服務(wù)能力逐步提升,安全水平顯著提高,為我國(guó)改革開放和社會(huì)主義現(xiàn)代化建設(shè)作出了突出貢獻(xiàn)。但當(dāng)前民航業(yè)發(fā)展中不平衡、不協(xié)調(diào)的問(wèn)題仍較為突出,空域資源配置不合理,基礎(chǔ)設(shè)施發(fā)展較慢,專業(yè)人才不足,企業(yè)競(jìng)爭(zhēng)力不強(qiáng)、管理體制有待理順等制約了我國(guó)民航業(yè)的可持續(xù)發(fā)展。對(duì)于具有自然壟斷性的民航運(yùn)輸業(yè),歐美等國(guó)對(duì)政府監(jiān)管基本上是持反對(duì)的態(tài)度,強(qiáng)調(diào)通過(guò)市場(chǎng)機(jī)制和法律措施來(lái)調(diào)節(jié)經(jīng)濟(jì)運(yùn)行,只會(huì)在迫不得已的情況下,才會(huì)同意由政府來(lái)采取監(jiān)管措施,從一定程度上說(shuō),這也基本是等于放棄了政府的監(jiān)管作用;而德國(guó)和日本則主張政府要更加積極的介入民航業(yè)這種經(jīng)濟(jì)活動(dòng)中去,發(fā)揮它巨大的監(jiān)管作用。政府是社會(huì)的管理者,社會(huì)政策的制定者、實(shí)踐者和維護(hù)者。政府在民航業(yè)發(fā)展管制問(wèn)題上的態(tài)度則起著發(fā)展好壞決定性的作用。通過(guò)加強(qiáng)法制建設(shè)、完善我國(guó)民航業(yè)相關(guān)法律法規(guī)政策、規(guī)范管制制度規(guī)范能力、加強(qiáng)管制指導(dǎo)和調(diào)控能力以及管制政策執(zhí)行能力等方面完善我國(guó)對(duì)民航業(yè)政府管制所應(yīng)采取的態(tài)度,并提出放松管制與政府監(jiān)管雙管齊下的相應(yīng)的對(duì)策建議。
[Abstract]:Absrtact: as a traditional monopoly industry, the government regulation of civil aviation transportation industry is an important subject that the governments of all countries are facing. It is also an important task for our government to promote economic restructuring in the following period of time. Since the reform and opening up, the civil aviation industry in China has developed rapidly, the scale of the industry has been continuously expanded, the service capacity has been gradually improved, and the level of safety has improved significantly. It has made outstanding contributions to China's reform, opening up and socialist modernization drive. However, the current development of the civil aviation industry is not balanced and uncoordinated, the allocation of airspace resources is unreasonable, the development of infrastructure is slow, and there are not enough professionals. The competitiveness of enterprises is not strong, the management system needs to be straightened out and so on, which restricts the sustainable development of China's civil aviation industry. For the civil aviation transport industry with natural monopoly, countries such as Europe and the United States are basically opposed to government supervision. The emphasis on regulating the economic operation through the market mechanism and legal measures will only be forced to the situation that the government will agree to take regulatory measures, to a certain extent, this is basically equivalent to giving up the role of government supervision; Germany and Japan, on the other hand, advocate that the government should be more actively involved in the economic activities of the civil aviation industry and play its enormous regulatory role. The government is the administrator of society and the maker of social policy. The attitude of the government on the development and regulation of civil aviation industry plays a decisive role in the development of the civil aviation industry. Through strengthening the legal system construction, perfecting the relevant laws, regulations and policies of the civil aviation industry in our country, and standardizing the control system and normative capacity, To improve the attitude of our country to the government regulation of the civil aviation industry from the aspects of strengthening the ability of regulation guidance and regulation and the ability of implementing the control policy and so on, this paper puts forward the corresponding countermeasures and suggestions for both deregulation and government supervision.
