【摘要】:高速公路的發(fā)展水平不僅標(biāo)志著一個(gè)國(guó)家交通現(xiàn)代化的水平,更代表著一個(gè)國(guó)家現(xiàn)代化的發(fā)展程度。近年來(lái),我國(guó)高速公路建設(shè)一直呈現(xiàn)穩(wěn)步增長(zhǎng)的態(tài)勢(shì),總體發(fā)展速度和規(guī)模位居世界第二。高速公路建設(shè)期長(zhǎng)、耗資高、技術(shù)性強(qiáng),容易受自然條件的影響,外加上各種政治、市場(chǎng)因素,使得其風(fēng)險(xiǎn)性較高。建設(shè)過(guò)程涉及到的參建方眾多,所以高速公路建設(shè)需要有一個(gè)完善的合同體系來(lái)實(shí)現(xiàn)全方位、全要素、全過(guò)程的管理,保證建設(shè)的正常進(jìn)行。目前,我國(guó)高速公路建設(shè)合同管理水平還有待提高,非法競(jìng)爭(zhēng)、誠(chéng)信危機(jī)、違反合同約定現(xiàn)象時(shí)有發(fā)生,需要加強(qiáng)監(jiān)督管理。所以,加強(qiáng)建設(shè)單位合同管理研究顯得尤為重要。 本文首先介紹了高速公路工程建設(shè)單位合同體系的構(gòu)成、特點(diǎn)和內(nèi)部協(xié)調(diào),然后分別從合同管理的外部環(huán)境和建設(shè)單位自身兩個(gè)方面分析了我國(guó)高速公路工程建設(shè)單位合同管理存在的問(wèn)題。接下來(lái)對(duì)國(guó)內(nèi)外合同管理的先進(jìn)經(jīng)驗(yàn)進(jìn)行分析,在此基礎(chǔ)上,對(duì)我國(guó)高速公路工程建設(shè)單位合同管理提出建議:合同管理外部環(huán)境方面包括健全法律法規(guī)、建立誠(chéng)信體系,發(fā)展合同模式,完善項(xiàng)目法人制和監(jiān)理制等;建設(shè)單位自身方面包括完善組織機(jī)構(gòu)、健全管理制度、提高人員素質(zhì)、加強(qiáng)信息化管理等。希望可供高速公路行業(yè)建設(shè)單位進(jìn)行合同管理時(shí)參考,更好地實(shí)現(xiàn)投資、進(jìn)度、質(zhì)量三大目標(biāo)的控制。
[Abstract]:The level of highway development not only marks the level of a country's traffic modernization, but also represents the development of a country's modernization. In recent years, highway construction in China has been showing a steady growth trend. The overall speed and scale of development is the second largest in the world. Expressway construction period is long, expensive, technical, easily influenced by natural conditions, plus various political and market factors. That makes it more risky. The construction process involves a large number of participants, so highway construction needs a perfect contract system to achieve all-around, all-factor, all-process management to ensure normal construction. At present, The level of contract management of highway construction in our country needs to be improved, illegal competition, credit crisis, breach of contract agreement phenomenon often occur, need to strengthen supervision and management, so it is particularly important to strengthen the research of contract management of construction units. This paper first introduces the structure, characteristics and internal coordination of the contract system of expressway construction units. Then it analyzes the existing problems of contract management of expressway construction units in China from two aspects: the external environment of contract management and the construction units themselves. Then, it analyzes the advanced experience of contract management at home and abroad, and on this basis, Some suggestions on contract management of expressway construction units in China are put forward: the external environment of contract management includes perfecting laws and regulations, establishing credit system, developing contract mode, perfecting project legal person system and supervision system, etc. The construction units themselves include perfecting the organization, perfecting the management system, improving the quality of the personnel, strengthening the information management, etc. It is hoped that it can be used as a reference for the expressway construction units to carry out contract management, and to better realize the investment and progress.
