國權(quán)視野下的晚清津浦鐵路研究

【摘要】:國權(quán)指的是國家主權(quán)、治權(quán)以及國家利益結(jié)合基礎(chǔ)上的國家權(quán)利,涉及政治、經(jīng)濟(jì)、軍事等多方面內(nèi)容。鐵路,特別是鐵路干線對國家政治、經(jīng)濟(jì)、社會生活等各個(gè)方面有著重要意義,鐵路的特殊地位使其興建、運(yùn)營均與國家權(quán)利密切相關(guān)。晚清津浦鐵路的籌建經(jīng)歷了國權(quán)喪失、爭取、復(fù)得的全過程,《津浦鐵路借款合同》的簽訂是晚清政府與社會各界力量共同努力的結(jié)果,是晚清收回利權(quán)運(yùn)動的重要組成部分。雖然該合同仍存在著許多缺陷與不足,但它使津鎮(zhèn)草約喪失的大量國權(quán)得以部分挽回,更開創(chuàng)了債、路分離的借款模式,,使其成為清末民初鐵路借款合同的藍(lán)本。此外,在鐵路建設(shè)中,為維護(hù)國權(quán),政府與社會力量各盡其能,發(fā)揮了不同的作用和影響。 本文引入“國權(quán)”這一概念,試圖以此為視角考察津浦鐵路籌建過程中國權(quán)的變化,揭示政府、社會力量在維護(hù)鐵路利權(quán)中的互動關(guān)系。在肯定《津浦鐵路借款合同》挽救國權(quán)的同時(shí),也充分意識到只有改變半殖民地半封建的舊中國的社會性質(zhì),實(shí)現(xiàn)國家獨(dú)立、民族自強(qiáng),才能從根本上維護(hù)國權(quán)。
[Abstract]:State power refers to the national rights based on the combination of national sovereignty, governance and national interests, and involves political, economic, military and other aspects. Railways, especially railway trunk lines, are relevant to national politics and economy. All aspects of social life are of great significance. The special status of railway makes its construction and operation closely related to the rights of the state. The preparation for the construction of the Jin-pu Railway in the late Qing Dynasty experienced the loss of national rights and the struggle for it. In the whole process of recovery, the signing of the "Jin-Pu Railway loan contract" was the result of the joint efforts of the government and various sectors of society in the late Qing Dynasty, and was an important part of the interest recovery movement in the late Qing Dynasty, although the contract still had many defects and shortcomings. However, it partially recovered a large number of state rights lost in Jinzhen and grass, and created a borrowing mode of separating debts and roads, which made it the blueprint of railway borrowing contracts in the late Qing Dynasty and early Republic of China. In addition, in order to safeguard the national rights in railway construction, The government and social forces do their best and play different roles and influences. This paper introduces the concept of "national power", and attempts to study the changes of national power in the process of construction of Jinpu railway from this angle of view, and reveal the government. While affirming the "Jin-Pu Railway loan contract" to save the rights of the country, social forces fully realized that only by changing the social nature of the semi-colonial and semi-feudal old China and achieving national independence, Only by strengthening the nation can we fundamentally safeguard national power.
