【摘要】：隨著世界經(jīng)濟的高速發(fā)展以及世界各個國家對職業(yè)教育領(lǐng)域發(fā)展的注重，職業(yè)教育正處在一個優(yōu)越的發(fā)展環(huán)境之中，校企合作作為職業(yè)教育特別重要高效的發(fā)展途徑，在發(fā)展中創(chuàng)造了很多好的產(chǎn)學研經(jīng)驗和模式，取得了突出成效。但凸顯出來的問題也很多，關(guān)于校企合作，我國一向非常關(guān)注，職業(yè)教育部門也特別重視，但校企合作的主體之一企業(yè)卻不瘟不火、甚至置之不理，這種現(xiàn)象并非企業(yè)與學校之間的合作本身有問題，而是企業(yè)很少或直接不受益。企業(yè)動力在哪、如何開展、企業(yè)與學校合作意愿不統(tǒng)一、經(jīng)營方式和管理模式不同、學校研發(fā)能力、學生技能水平較差和企業(yè)積極性不夠或達不到長期合作等一系列現(xiàn)象長期得不到解決，這些現(xiàn)象一直不能有效根除的根本原因就是沒有相關(guān)完整的法律法規(guī)來保障。 盡管我國以《職業(yè)教育法》為核心，，以相關(guān)制度決定和地方條例為輔的職業(yè)教育法律體系雛形己基本形成，但是該體系內(nèi)容欠缺不完整、可操作性差，國家出臺的相關(guān)法律對校企合作的規(guī)定零星分散，《職業(yè)教育法》在規(guī)定內(nèi)容的數(shù)量與質(zhì)量上都不盡如人意，各地方也沒有切合當?shù)芈殬I(yè)教育發(fā)展的條例與辦法，使得校企合作無章可循。因此，在當前職業(yè)教育蓬勃發(fā)展的關(guān)鍵時期，修改與制定校企合作法律法規(guī)，保證職業(yè)教育校企合作的健康發(fā)展，是當務(wù)之急。本文主要運用文獻法、比較法、社會調(diào)查法、規(guī)范和實證相結(jié)合的研究方法，通過搜集、整理了大量的相關(guān)文獻資料，梳理闡述國內(nèi)及國外校企合作法律研究及發(fā)展情況，從職業(yè)教育法律體系建設(shè)與校企合作實施效果入手，對職業(yè)教育校企合作改革開放以后的法律法規(guī)進行梳理，采用訪談法，對陜西兩所職業(yè)院校校企合作的現(xiàn)狀進行調(diào)查，了解校企合作實際不足，在梳理闡述職業(yè)教育發(fā)展成效突出國家校企合作法律法規(guī)的建設(shè)經(jīng)驗基礎(chǔ)上，參考、汲取教育學者的學術(shù)經(jīng)驗，結(jié)合我國職業(yè)教育校企合作開展實施的實際和相關(guān)法律法規(guī)建設(shè)近況，對如何建設(shè)和完整職業(yè)教育校企合作法律保障體系建議有關(guān)對策。
[Abstract]:With the rapid development of the world economy and the attention paid by every country in the world to the development of vocational education, vocational education is in a superior development environment. School-enterprise cooperation is a particularly important and efficient way to develop vocational education.In the development has created a lot of good production and research experience and model, achieved outstanding results.However, there are also many outstanding problems. Our country has always been very concerned about the cooperation between schools and enterprises, and the vocational education departments have also attached particular importance to it. However, one of the main bodies of cooperation between schools and enterprises is not too hot or even ignored.This phenomenon is not the problem of cooperation between enterprises and schools, but enterprises with little or no direct benefit.Where is the motive force of the enterprise, how to develop it, the willingness of cooperation between the enterprise and the school is not unified, the management mode and management mode are different, and the research and development ability of the school is different.A series of phenomena, such as poor students' skill level and lack of enthusiasm or cooperation between enterprises, can not be solved for a long time. The fundamental reason why these phenomena can not be effectively eradicated is that there are no relevant laws and regulations to protect them.Although the rudiments of the legal system of vocational education, which is based on the "Vocational Education Law" as the core and supplemented by the relevant system decisions and local regulations, has been basically formed, but the contents of the system are not complete and the operability is poor.The relevant laws issued by the state have scattered provisions on cooperation between schools and enterprises. The Vocational Education Law is not satisfactory in terms of the quantity and quality of the prescribed contents, and there are no regulations and measures to suit the development of local vocational education in various localities.So that school-enterprise cooperation can be followed.Therefore, in the key period of the flourishing development of vocational education, it is urgent to revise and formulate the laws and regulations of the cooperation between the school and the enterprise to ensure the healthy development of the cooperation between the school and the enterprise in the vocational education.This article mainly uses the literature method, the comparison law, the social investigation method, the norm and the demonstration unifies the research method, through the collection, collates the massive correlation literature material, combs the elaboration domestic and the foreign school enterprise cooperation law research and the development situation.Starting with the construction of the legal system of vocational education and the effect of the cooperation between the school and the enterprise, this paper combs the laws and regulations of the cooperation between the school and the enterprise after the reform and opening up, and adopts the interview method to investigate the present situation of the cooperation between the school and the enterprise in the two vocational colleges in Shaanxi.To understand the actual shortage of school-enterprise cooperation, on the basis of combing and expounding the construction experience of the national laws and regulations on the development of vocational education, and drawing on the academic experience of educational scholars,According to the actual situation of the implementation of the cooperation between the vocational education schools and enterprises in our country and the recent situation of the relevant laws and regulations, this paper suggests some countermeasures on how to build and complete the legal guarantee system of the cooperation between the vocational education schools and enterprises.
