【摘要】：近幾年，伴隨我國高等教育事業(yè)的改革與發(fā)展，高等院校大學生人數(shù)逐年增長。然而與此同時，高校校園傷害事故發(fā)生率也逐年升高，由此引發(fā)的民事賠償糾紛與日俱增。高校校園傷害事故的發(fā)生不僅給很多學生的家庭帶來了不幸，而且由于相關(guān)高校校園事故法律法規(guī)和制度的不完善，使得高校在處理賠償事宜時沒有統(tǒng)一標準，，占用了較多的教育經(jīng)費�？梢哉f每年較多的賠償費用，給高校帶來了一定的負擔。本文以我國公立高校校園傷害事故為研究對象，通過運用調(diào)查研究法、文獻研究法、案例分析法、比較分析法、歷史分析法等研究方法，闡述高校校園的安全事故的現(xiàn)狀和高校學生傷害事故的內(nèi)涵，分析高校與大學生之間的法律關(guān)系和傷害事故的歸責原則，分析高校應(yīng)承擔的法定義務(wù)以及公立高校在校園傷害事故中所應(yīng)承擔的民事責任和免責事由、損害賠償問題。一方面為高校在賠償問題上提供標準，一方面為高校減少教育經(jīng)費的不必要浪費。本文通過理論分析和借鑒美國等國家的高校校園安全管理制度和賠償制度，建議完善我國高校校園安全立法，建立高校校園危險信息公開及危險提醒制度、校園傷害事故責任保險制度、校園交通管理制度、校園心理健康干預機制和校園警察制度。
[Abstract]:In recent years, with the reform and development of higher education in China, the number of college students is increasing year by year. However, at the same time, the incidence of campus injury accidents is also increasing year by year, resulting in increasing civil compensation disputes. The occurrence of campus injury accident not only brings misfortune to the families of many students, but also because of the imperfect laws, regulations and systems of the related campus accident, there is no uniform standard when dealing with compensation matters. It takes up more funds for education. It can be said that the annual compensation costs have brought a certain burden to colleges and universities. This article takes the campus injury accident of our country public university as the research object, through the use of the investigation research method, the literature research method, the case analysis method, the comparative analysis method, the historical analysis method and so on research method. This paper expounds the present situation of college campus safety accidents and the connotation of college students' injury accidents, and analyzes the legal relationship between universities and college students and the principle of imputation of injury accidents. This paper analyzes on the legal obligations of colleges and universities, as well as the civil liability and exoneration of public colleges and universities in campus injury accidents, and the problem of compensation for damages. On the one hand, it provides the standard for colleges and universities to compensate, on the other hand, it reduces the unnecessary waste of educational funds. Based on the theoretical analysis and reference of the campus safety management system and compensation system in the United States and other countries, this paper proposes to perfect the campus safety legislation in our country, and to establish the disclosure and warning system of the dangerous information on the campus of colleges and universities. Campus injury accident liability insurance system, campus traffic management system, campus mental health intervention mechanism and campus police system.
