【摘要】：高等教育體制和大學(xué)治理方式的改革是深刻而復(fù)雜、全面而系統(tǒng)的改革,決不僅僅是制定大學(xué)章程就能完成的。曲解大學(xué)章程的本質(zhì)、混淆大學(xué)章程的性質(zhì)、夸大大學(xué)章程的效力,是加強(qiáng)章程建設(shè)、完善治理結(jié)構(gòu)、構(gòu)建現(xiàn)代大學(xué)制度必須克服的三種傾向。大學(xué)章程性質(zhì)的內(nèi)部性與效力的有限性,決定了當(dāng)前大學(xué)治理方式的改革必須以健全的大學(xué)法為依據(jù),以大學(xué)章程為基礎(chǔ),以行政與司法監(jiān)督為保障,實(shí)現(xiàn)三者的有機(jī)統(tǒng)一。
[Abstract]:The reform of the system of higher education and the mode of university governance is profound and complex, comprehensive and systematic reform, not just the establishment of university regulations can be completed. To misinterpret the essence of the university charter, to confuse the nature of the university charter and to exaggerate the effect of the university charter are the three tendencies that must be overcome in strengthening the constitution construction, perfecting the governance structure and constructing the modern university system. The internal nature of the university charter and the limitation of its effectiveness determine that the reform of the current university governance must be based on sound university law, be based on the university charter, and be guaranteed by administration and judicial supervision, and realize the organic unity of the three.
