【摘要】：大學(xué)是學(xué)術(shù)的殿堂,象征著學(xué)術(shù)良知,并以科學(xué)文化服務(wù)于社會(huì)。學(xué)術(shù)研究不斷地將學(xué)術(shù)理論運(yùn)用到實(shí)踐中,來(lái)推動(dòng)科技的發(fā)展和整個(gè)社會(huì)的進(jìn)步。學(xué)術(shù)和科技力量的發(fā)展離不開(kāi)在科研崗位孜孜不倦工作和刻苦鉆研的學(xué)者們,于是高校作為高素質(zhì)人才培養(yǎng)基地,備受?chē)?guó)家重視。改革開(kāi)放以來(lái),我國(guó)高校學(xué)術(shù)事業(yè)迅速發(fā)展,研究隊(duì)伍日益壯大,素質(zhì)結(jié)構(gòu)不斷優(yōu)化,研究領(lǐng)域也有了新的拓展。 然而令人失望的是,很多高校的教學(xué)科研活動(dòng)中出現(xiàn)了各種腐敗現(xiàn)象,有抄襲、剽竊他人研究成果,篡改、偽造實(shí)驗(yàn)數(shù)據(jù),壟斷學(xué)術(shù)資源等等。近年來(lái),這股腐敗之風(fēng)愈演愈烈,不僅破壞學(xué)術(shù)規(guī)則、腐蝕學(xué)術(shù)隊(duì)伍、污染學(xué)術(shù)環(huán)境,造成大量科研資源的浪費(fèi),還將阻礙學(xué)術(shù)水平的提升和科學(xué)文化事業(yè)的發(fā)展。因此積極探討治理學(xué)術(shù)腐敗的措施,有效預(yù)防和懲治高校學(xué)術(shù)腐敗,顯得尤為迫切。 本文圍繞發(fā)生在高校領(lǐng)域的學(xué)術(shù)腐敗現(xiàn)象,抓住其本質(zhì)特征,分析學(xué)術(shù)腐敗的類(lèi)型及具體表現(xiàn)形式,并對(duì)其已經(jīng)造成或即將造成的嚴(yán)重危害進(jìn)行剖析。相關(guān)主管部門(mén)也采取了一些積極的應(yīng)對(duì)和控制學(xué)術(shù)腐敗蔓延的措施,本文從道德治理和法律懲治兩方面分析了當(dāng)前我國(guó)高校學(xué)術(shù)腐敗的治理現(xiàn)狀,在此基礎(chǔ)上分析了學(xué)術(shù)腐敗治理過(guò)程中存在的問(wèn)題,主要有相關(guān)立法落后、監(jiān)督機(jī)制流于形式、懲罰程序不透明、懲罰力度較小等方面。 最后,本文以浙江大學(xué)的陳英旭案件為例,對(duì)學(xué)術(shù)腐敗的成因及治理對(duì)策進(jìn)行剖析和研究。通過(guò)對(duì)案例的分析,為本文研究高校學(xué)術(shù)腐敗的懲治提供一些思路。最后結(jié)合我國(guó)高校學(xué)術(shù)腐敗的實(shí)情,本文從完善懲治學(xué)術(shù)腐敗的立法、改善科研管理體制、強(qiáng)化執(zhí)法、加強(qiáng)并完善司法審查與監(jiān)督機(jī)制四個(gè)方面完善我國(guó)懲治學(xué)術(shù)腐敗的法治框架。
[Abstract]:The university is the palace of the academic, symbolizes the academic conscience, and serves the society with the science culture. Academic research continuously applies academic theory to practice to promote the development of science and technology and the progress of the whole society. The development of academic and scientific forces can not be separated from the scholars who work tirelessly and assiduously in scientific research posts, so colleges and universities, as a base for training high-quality talents, are attached great importance to by the state. Since the reform and opening up, the academic cause of colleges and universities in our country has developed rapidly, the research team has been growing day by day, the quality structure has been optimized constantly, and the research field has also been expanded. However, it is disappointing that there are many kinds of corruption in the teaching and research activities of many universities, such as plagiarism, tampering, falsifying experimental data, monopolizing academic resources and so on. In recent years, this trend of corruption is becoming more and more serious. It not only destroys academic rules, corrodes academic staff, pollutes academic environment, causes waste of a large number of scientific research resources, but also hinders the improvement of academic level and the development of scientific and cultural undertakings. Therefore, it is urgent to actively discuss the measures to prevent and punish academic corruption in colleges and universities. This paper focuses on the phenomenon of academic corruption in the field of colleges and universities, grasps its essential characteristics, analyzes the types and concrete forms of academic corruption, and analyzes the serious harm it has caused or is about to cause. The relevant departments have also taken some positive measures to deal with and control the spread of academic corruption. This paper analyzes the current governance situation of academic corruption in colleges and universities in China from the aspects of moral governance and legal punishment. On this basis, this paper analyzes the problems existing in the process of governance of academic corruption, mainly in the following aspects: the relative legislation is backward, the supervision mechanism is mere formality, the punishment procedure is not transparent, and the punishment intensity is relatively small. Finally, taking the case of Chen Yingxu in Zhejiang University as an example, this paper analyzes and studies the causes and countermeasures of academic corruption. Through the analysis of cases, this paper provides some ideas for the punishment of academic corruption in colleges and universities. Finally, combined with the facts of academic corruption in colleges and universities in China, this paper tries to improve the legislation on punishing academic corruption, improve the scientific research management system, and strengthen the law enforcement. Strengthening and perfecting the judicial review and supervision mechanism, perfecting the legal framework of punishing academic corruption in our country.
