高校學(xué)生社團(tuán)問(wèn)題研究

【摘要】:高校學(xué)生社團(tuán)建設(shè)由于其所具有的特殊作用在近年來(lái)越來(lái)越為人們所重視,特別是2004年《中共中央、國(guó)務(wù)院關(guān)于進(jìn)一步加強(qiáng)和改進(jìn)大學(xué)生思想政治教育的意見(jiàn)》(中發(fā)[2004]16號(hào))發(fā)布后,對(duì)于高校學(xué)生社團(tuán)在高校學(xué)生思想政治教育領(lǐng)域內(nèi)重要作用的認(rèn)識(shí)被提到了一個(gè)新的高度。 遺憾的是,我國(guó)高校學(xué)生社團(tuán)的研究還處于起步階段,對(duì)于時(shí)代發(fā)展所帶來(lái)的各種各樣的問(wèn)題還沒(méi)有清晰的思路,這一方面是由于我國(guó)整體上對(duì)于社會(huì)團(tuán)體管理的法律建設(shè)和管理手段還不完善,對(duì)于社會(huì)團(tuán)體的法律地位、權(quán)利義務(wù)關(guān)系、社團(tuán)法人界定等方面還存在模糊不清和限定不明的明顯問(wèn)題,另一方面是由于高校學(xué)生社團(tuán)自身所具有的特殊性在很大程度上阻礙了高校學(xué)生社團(tuán)發(fā)展過(guò)程中自治力與外驅(qū)力的有效、適度發(fā)揮。因此,對(duì)高校學(xué)生社團(tuán)問(wèn)題進(jìn)行研究具有重要意義,而其研究現(xiàn)狀又不能滿足實(shí)際需求,這就為本研究提供了有益的契機(jī);诟咝W(xué)生社團(tuán)發(fā)展過(guò)程中存在的問(wèn)題,本文從三個(gè)方面進(jìn)行了較為深入的分析。 第一,高校學(xué)生社團(tuán)法律地位探析。在本部分,本文試圖對(duì)高校學(xué)生社團(tuán)法律地位作出系統(tǒng)梳理,以明確高校學(xué)生社團(tuán)的法律地位,進(jìn)而對(duì)其法定范圍內(nèi)的權(quán)利義務(wù)關(guān)系進(jìn)行界定。對(duì)此有三點(diǎn)結(jié)論:一是由于高校學(xué)生社團(tuán)成立于高校內(nèi)部,因此可以將之視為高校內(nèi)部成立的,在高校內(nèi)部活動(dòng)的學(xué)生自治組織,而這類組織按照相關(guān)法律規(guī)定應(yīng)當(dāng)向高校相關(guān)部門進(jìn)行登記、注冊(cè)和備案,并接受相應(yīng)的管理,而不需要再向各級(jí)政府的民政部門申報(bào)、登記和備案;二是高校學(xué)生社團(tuán)從屬于高校這一事業(yè)單位法人(國(guó)內(nèi)對(duì)于這一界定還存在爭(zhēng)論),從法律意義上說(shuō),其并不能承擔(dān)相應(yīng)的法律責(zé)任,不具備法人資格;三是高校學(xué)生社團(tuán)雖然并不具備社團(tuán)法人的資格,但是其本質(zhì)上仍是由高校學(xué)生自愿組成的,以實(shí)現(xiàn)會(huì)員共同意愿的組織,因此其仍具有自我管理、自我組織的權(quán)利,但這一權(quán)利的實(shí)現(xiàn)應(yīng)基于其活動(dòng)遵守法律并按照章程開(kāi)展的基礎(chǔ)之上。據(jù)此,我們進(jìn)一步分析闡釋了高等學(xué)校與學(xué)生、高等學(xué)校與高校共青團(tuán)組織、高校學(xué)生社團(tuán)與高等學(xué)校共青團(tuán)組織之間的關(guān)系,為進(jìn)一步分析奠定基礎(chǔ)。 第二,高校學(xué)生社團(tuán)發(fā)展過(guò)程中的問(wèn)題分析。在本部分,本文針對(duì)已有的研究結(jié)果,結(jié)合調(diào)研數(shù)據(jù),系統(tǒng)分析了高校學(xué)生社團(tuán)發(fā)展過(guò)程中出現(xiàn)的高校學(xué)生社團(tuán)自治力的不足、高校學(xué)生社團(tuán)自治力的擴(kuò)張、高校學(xué)生社團(tuán)外驅(qū)力的缺失、高校學(xué)生社團(tuán)外驅(qū)力的內(nèi)引等顯著問(wèn)題。并對(duì)這些問(wèn)題出現(xiàn)后對(duì)高校學(xué)生社團(tuán)發(fā)展產(chǎn)生的不良后果進(jìn)行了分析。一方面,這些問(wèn)題的出現(xiàn)直接導(dǎo)致了高校學(xué)生社團(tuán)發(fā)展的滯后及組織的異化;另一方面,這些問(wèn)題的出現(xiàn)對(duì)于高校學(xué)生社團(tuán)作用的良性發(fā)揮產(chǎn)生了阻滯作用?傮w看來(lái),高校學(xué)生社團(tuán)發(fā)展過(guò)程中出現(xiàn)的諸多問(wèn)題是由多方面因素所導(dǎo)致的,主要表現(xiàn)在四個(gè)方面:一是高校學(xué)生社團(tuán)發(fā)展過(guò)程中的“二力”失衡;二是高校學(xué)生社團(tuán)發(fā)展過(guò)程中的制度缺失;三是高校學(xué)生社團(tuán)自身的復(fù)雜性;四是高校學(xué)生社團(tuán)發(fā)展過(guò)程中的環(huán)境多樣性。對(duì)于這些問(wèn)題的清晰認(rèn)識(shí),有助于我們對(duì)于高校學(xué)生社團(tuán)問(wèn)題的解決提出較為有效的對(duì)策。 第三,高校學(xué)生社團(tuán)發(fā)展策略分析。本文在已有研究的基礎(chǔ)上,結(jié)合實(shí)際,對(duì)于高等學(xué)校學(xué)生社團(tuán)發(fā)展過(guò)程中遇到的問(wèn)題提出了相應(yīng)的解決策略。研究主要從高校學(xué)生社團(tuán)的法律地位出發(fā),著手于正確發(fā)揮其權(quán)利和義務(wù),依據(jù)治理理論,以適度、平衡、多維的思維視野,試圖在多主體參與、適度參與、多維參與的層面給出高校學(xué)生社團(tuán)發(fā)展的合理路徑,使高校學(xué)生社團(tuán)發(fā)展能夠回歸合理、適切的軌跡。
[Abstract]:The construction of student associations in Colleges and universities has been paid more and more attention in recent years, especially in the 2004 "the Central Committee of the Communist Party of China, the opinion of the State Council on Further Strengthening and improving the ideological and political education of college students" (No. [2004]16), for college student associations in the field of Ideological and political education in Colleges and universities. The recognition of the important role has been mentioned to a new height.
Unfortunately, the study of college student associations in China is still in its infancy. There is no clear idea about all kinds of problems brought about by the development of the times. This is due to the incomplete legal construction and management methods for the management of social groups in our country, and the legal status of social groups and the relationship of rights and obligations. On the other hand, the particularity of the college student associations hinders the effective and moderate exertion of autonomy and external drive in the course of the development of College Students' associations. Therefore, the research on the problem of college student associations is carried out. It has important significance, and its research status can not meet the actual needs, which provides a useful opportunity for this study. Based on the problems existing in the process of the development of college student associations, this paper has carried out a more in-depth analysis from three aspects.
The first is the legal status of college student associations. In this part, this article tries to make a systematic review of the legal status of college student associations in order to clarify the legal status of college student associations, and then to define the rights and obligations within their legal scope. There are three conclusions: one is that college student associations are established in Colleges and universities. As a result, it can be considered as a student self-governing organization that is established within the universities and within the colleges and universities. In accordance with the relevant laws and regulations, the organizations should register, register and register with the relevant departments of the University, and accept the corresponding management, and do not need to declare, register and record them to the civil affairs departments of the governments at all levels, and two are colleges and universities. From the legal sense, the student association can not bear the corresponding legal responsibility and do not have the legal person qualification. The three is that the college student association does not have the qualification of the Corporation, but it is still made up of the students voluntarily. The organization that realizes the common will of members, therefore, still has the right to self-management and self-organization, but the realization of this right should be based on the basis for its activities to comply with the law and in accordance with the constitution. Accordingly, we further analyze and explain the organization of higher schools and students, the Communist Youth League of higher schools and universities, college student associations and high school students. The relationship between the Communist Youth League organizations and other schools lay the foundation for further analysis.
Second, analysis of the problems in the development of college student associations. In this part, this article, in view of the existing research results, combined with the survey data, systematically analyzes the lack of autonomy of college student associations in the course of the development of college student associations, the expansion of the autonomy of the College students' associations, the lack of the external drive of the college students' associations, and the colleges and universities. On the one hand, the emergence of these problems directly leads to the lag of the development of College Students' associations and the alienation of the organization; on the other hand, the emergence of these problems has the role of the college student association. In general, many problems in the development of college student associations are caused by many factors, mainly in four aspects: one is the "two force" imbalance in the development of college student associations; two is the lack of system in the development of college student associations; three is high. The complexity of the school students' community itself; four is the environmental diversity in the course of the development of college student associations. A clear understanding of these problems will help us to put forward more effective countermeasures for solving the problem of college student associations.
Third, analysis of the development strategy of college student associations. On the basis of the existing research, this paper puts forward corresponding solutions to the problems encountered in the process of the development of college student associations. A reasonable, balanced and multidimensional view of thinking, trying to give a reasonable path to the development of College Students' associations in the aspects of multi subject participation, moderate participation and multidimensional participation, so that the development of college student associations can return to a reasonable and reasonable path.
