【摘要】：大學(xué)章程是依法治教的重要組成部分，是現(xiàn)代大學(xué)制度建設(shè)的重要內(nèi)涵。成熟的法治國(guó)家，需要有“上承國(guó)家教育法律法規(guī)、下啟學(xué)校規(guī)章制度”的大學(xué)章程來(lái)規(guī)范學(xué)校的辦學(xué)行為，界定學(xué)校的運(yùn)行機(jī)制。因此，章程被稱為大學(xué)發(fā)展、建設(shè)與管理的“憲法”。當(dāng)前我國(guó)部分高校正在開展制定章程的試點(diǎn)工作，同時(shí)，教育部公布了《高等學(xué)校章程制定暫行辦法》，要求全國(guó)高校陸續(xù)制定出臺(tái)大學(xué)章程。但是，，我們?cè)诖髮W(xué)章程的理論和實(shí)踐上還缺乏系統(tǒng)的研究，在操作層面的政策上更缺乏規(guī)范性的指導(dǎo)意見。 本文通過(guò)界定大學(xué)章程的定義，揭示了我國(guó)大學(xué)章程的發(fā)展歷程和作用，進(jìn)一步討論了我國(guó)大學(xué)章程制定實(shí)施過(guò)程中關(guān)于解決好內(nèi)外部關(guān)系、章程制定主體、制定程序、修改程序和大學(xué)章程的基本內(nèi)容框架等理論問(wèn)題，分析了當(dāng)前大學(xué)章程制定實(shí)施的現(xiàn)狀和存在的問(wèn)題，探索提出了當(dāng)前我國(guó)大學(xué)章程制定實(shí)施的現(xiàn)實(shí)選擇：第一，全方位提升認(rèn)識(shí)是大學(xué)章程科學(xué)制定實(shí)施的前提保障。第二，深化教育管理體制改革是大學(xué)章程制定實(shí)施的必要條件。第三，政府參與大學(xué)章程制定是保證大學(xué)章程法律和效力的核心。第四，學(xué)術(shù)權(quán)力“復(fù)位”是大學(xué)章程得以有效實(shí)施的核心要求。第五，建立健全大學(xué)章程的配套機(jī)制和措施是大學(xué)章程有效實(shí)施的后續(xù)保證。同時(shí)，嘗試性地提出了適合我國(guó)實(shí)際情況的大學(xué)章程基本模式。
[Abstract]:The constitution of university is an important part of managing education according to law and the important connotation of the construction of modern university system. In a mature country ruled by law, it is necessary to have the university articles of association which "accept the national education laws and regulations, and the rules and regulations of the lower school" to standardize the school running behavior and define the operating mechanism of the school. Therefore, the constitution is called the "Constitution" of university development, construction and management. At present, some colleges and universities in our country are carrying out the pilot work of making articles of association. At the same time, the Ministry of Education has published the interim measures for the formulation of the articles of Association of Colleges and Universities. However, there is a lack of systematic research on the theory and practice of the university charter, and a lack of normative guidance on the operational policy. By defining the definition of the university charter, this paper reveals the development course and function of the university charter in China, and further discusses how to solve the internal and external relations, the main body and the procedure of the constitution formulation in the process of making and implementing the university charter in our country. This paper analyzes the current situation and existing problems of the establishment and implementation of the university charter, and probes into the practical options for the establishment and implementation of the university charter in our country: first, All-round promotion of understanding is the prerequisite for the scientific formulation and implementation of the university charter. Second, deepening the reform of the educational management system is a necessary condition for the establishment and implementation of the university charter. Third, government participation in the making of university charter is the core of ensuring the law and effect of university charter. Fourthly, the restoration of academic power is the core requirement for the effective implementation of university charter. Fifth, establishing and perfecting the supporting mechanism and measures of the university charter is the follow-up guarantee for the effective implementation of the university charter. At the same time, the paper tries to put forward the basic model of university charter suitable for the actual situation of our country.
