我國當(dāng)代高校法制教育問題與對(duì)策研究

【摘要】:進(jìn)入新世紀(jì)以來,在全球化、市場化、信息化的大背景下,我國社會(huì)主義現(xiàn)代化建設(shè)進(jìn)程不斷加快,法制建設(shè)水平有了顯著提高,特別是隨著素質(zhì)教育的推進(jìn),高校法制教育改革發(fā)展成果豐碩。但在肯定成績的同時(shí),也應(yīng)該看到當(dāng)前高校法制教育仍然存在一些問題。我國正處在“十二五”規(guī)劃實(shí)施的關(guān)鍵時(shí)期,有效解決這些矛盾問題,對(duì)高校法制教育以科學(xué)定位,進(jìn)一步提高大學(xué)生法律素養(yǎng),不僅關(guān)系到我國教育現(xiàn)代化的發(fā)展和高素質(zhì)人才隊(duì)伍的建設(shè),也是我國建設(shè)法治國家,構(gòu)建和諧社會(huì)的迫切需要。 全文共分為四個(gè)部分。 首先,筆者通過對(duì)相關(guān)概念和理論的研究,結(jié)合具體實(shí)踐,進(jìn)一步明確了高校法制教育的定位,即高校法制教育是高校思想政治教育的組成部分,但也具有明顯的相對(duì)獨(dú)立特性。對(duì)以往把高校法制教育盲目隸屬于德育的做法進(jìn)行反駁,主張著力凸顯高校法制教育應(yīng)有的獨(dú)立性地位。 其次,通過發(fā)放調(diào)查問卷,對(duì)省內(nèi)部分高校學(xué)生進(jìn)行了法制教育方面的專項(xiàng)調(diào)查,從高校學(xué)生的法律意識(shí)、法律知識(shí)、法律能力、法律信仰等方面,初步分析了當(dāng)前我國高校法制教育的現(xiàn)狀。 再次,結(jié)合相關(guān)理論和調(diào)研數(shù)據(jù),對(duì)我國高校法制教育存在的問題進(jìn)行深入研究,總結(jié)出以下五方面主要問題:高校對(duì)法制教育的重視程度不夠,定位不夠合理,存在一定主觀阻力;高校法制教育模式仍相對(duì)落后,受傳統(tǒng)教育模式影響較大;法制教育課程設(shè)置和師資配備都不盡合理;高校學(xué)生的個(gè)體特征顯著,心理健康狀況對(duì)法制教育造成一定阻力;此外,家庭和社會(huì)環(huán)境的負(fù)面因素對(duì)高校法制教育也存在一定影響。 最后,針對(duì)這五方面問題,筆者從以上五個(gè)問題入手,從學(xué)校、社會(huì)、家庭和學(xué)生自身四個(gè)角度出發(fā),對(duì)解決問題的對(duì)策進(jìn)行了初步探究。認(rèn)為高校應(yīng)提高對(duì)法制教育的重視程度,改革法制教育模式,優(yōu)化法律課程設(shè)置,加強(qiáng)師資隊(duì)伍建設(shè),將心理健康教育與高校法制教育相結(jié)合,并提出通過構(gòu)建高校、家庭、社會(huì)三方結(jié)合的網(wǎng)絡(luò)化法制教育體系,著力破解我國高校法制教育面臨的各種難題。
[Abstract]:Since the beginning of the new century, under the background of globalization, marketization and information, the process of socialist modernization in China has been continuously accelerated, and the level of legal construction has improved significantly, especially with the advancement of quality education. The reform and development of legal education in colleges and universities have achieved fruitful results. However, while affirming the achievements, we should also see that there are still some problems in the legal education of colleges and universities. China is in the crucial period of the implementation of the 12th Five-Year Plan. To solve these contradictions effectively, to scientifically position the legal education in colleges and universities, to further improve the legal literacy of college students, is not only related to the development of our country's educational modernization and the construction of high-quality talents, but also the construction of our country ruled by law. The urgent need of building a harmonious society. The full text is divided into four parts. First of all, through the research of related concepts and theories, combined with the concrete practice, the author further defines the orientation of the legal education in colleges and universities, that is, the legal education in colleges and universities is an integral part of the ideological and political education in colleges and universities. But it also has the characteristic of relative independence. The author refutes the past practice of blindly subordinating the legal education in colleges and universities to moral education, and advocates that the independent position of the legal education in colleges and universities should be highlighted. Secondly, through the distribution of questionnaires, some college students in the province were investigated in legal education, from the aspects of legal consciousness, legal knowledge, legal ability, legal belief and so on. This paper analyzes the current situation of legal education in colleges and universities in China. Thirdly, combining with the relevant theory and investigation data, this paper makes an in-depth study on the problems existing in the legal education of colleges and universities in our country, and summarizes the following five main problems: the degree of attention to the legal education is not enough, and the orientation is not reasonable enough in colleges and universities. There is a certain subjective resistance; the legal education model of universities is still relatively backward, greatly influenced by the traditional education model; the legal education curriculum and teacher allocation are unreasonable; the individual characteristics of college students are significant. In addition, the negative factors of family and social environment have some influence on the legal education in colleges and universities. Finally, aiming at these five problems, the author starts with the above five problems, starting from the four angles of school, society, family and students themselves. This paper probes into the countermeasures to solve the problems, and points out that colleges and universities should pay more attention to legal education, reform the mode of legal education, optimize the course of law, and strengthen the construction of teaching staff. This paper combines the psychological health education with the legal education in colleges and universities, and puts forward that through the construction of the network legal education system of university, family and society, we can solve all kinds of difficult problems faced by the legal education in colleges and universities in our country.
