【摘要】：如何構(gòu)建現(xiàn)代大學(xué)制度已經(jīng)成為我國高等教育研究的熱點(diǎn)之一,本文在對(duì)現(xiàn)有文獻(xiàn)資料進(jìn)行梳理基礎(chǔ)上,認(rèn)為目前我國公立大學(xué)建立現(xiàn)代大學(xué)制度,應(yīng)當(dāng)借鑒其它國家和地區(qū)的優(yōu)秀經(jīng)驗(yàn),以法人治理結(jié)構(gòu)為出發(fā)點(diǎn),調(diào)整大學(xué)與政府、大學(xué)與社會(huì)以及大學(xué)與其內(nèi)部各利益相關(guān)者之間的相互關(guān)系。近年來我國公立大學(xué)的發(fā)展雖已取得了很大的成績,但無論是外部管理還是內(nèi)部運(yùn)行,仍存在著不少的問題,從外部管理上主要表現(xiàn)在政府對(duì)大學(xué)的管理存在著缺位、越位現(xiàn)象,造成了大學(xué)辦學(xué)自主權(quán)得不到較好實(shí)現(xiàn),另外也存在著社會(huì)對(duì)大學(xué)辦學(xué)的參與程度不高的問題；從內(nèi)部運(yùn)行上主要表現(xiàn)在大學(xué)內(nèi)部的權(quán)力分配上表現(xiàn)為行政權(quán)力過分集中,學(xué)術(shù)權(quán)力得不到保障,教師、學(xué)生的民主參與權(quán)被邊緣化等。大學(xué)的法人治理結(jié)構(gòu)不完全,直接影響了我國公立大學(xué)的發(fā)展,限制了學(xué)術(shù)自由,延緩了公立大學(xué)現(xiàn)代大學(xué)制度構(gòu)建的步伐。 要建立起符合我國國情的現(xiàn)代大學(xué)制度,可以從大學(xué)的內(nèi)外部治理結(jié)構(gòu)出發(fā),建立我國現(xiàn)代大學(xué)制度的內(nèi)外部保障體系。從我國公立大學(xué)的外部而言,不僅要實(shí)現(xiàn)政府的職能轉(zhuǎn)變,還大學(xué)辦學(xué)自主權(quán),還要鼓勵(lì)社會(huì)積極參與到大學(xué)的辦學(xué)中來,為大學(xué)提供支持與監(jiān)督。從內(nèi)部的保障體系上,要實(shí)現(xiàn)大學(xué)內(nèi)部政治、行政、學(xué)術(shù)三者分權(quán)治理,建立起符合現(xiàn)代大學(xué)發(fā)展的法人治理結(jié)構(gòu)。
[Abstract]:How to build a modern university system has become a hot research topic in Higher Education of our country, in this paper, on the basis of organizing existing literature, that the current public universities in China to establish a modern university system should learn from the experience of other countries and regions, with the corporate governance structure as the starting point, the adjustment of the relationship between University and government. The University and society, University and the internal stakeholders. In recent years, the development of public universities in China has made great achievements, but whether it is external or internal management operation, there are still a lot of problems, from outside management, mainly in the government management of the university there is a vacancy, offside. Caused the university autonomy in running schools is not good, but also there is a degree of social participation of universities is not high; from the internal operation of the main table Now the University's internal power distribution on the performance of the excessive concentration of administrative power, academic power is not guaranteed, teachers, students' democratic participation right is marginalized. The corporate governance structure of the university is not complete, has a direct impact on the development of our public universities, restricted academic freedom, delayed the construction of modern university system in public the pace of the University.
To establish a modern university system in line with China's national conditions, can start from the internal and external governance structure of the University, the establishment of modern university system in China's internal and external security system. From the external public university in our country, not only to achieve the transformation of government functions, but also the university autonomy, but also to encourage the community to actively participate in the university the school to provide support and supervision for the University. From the internal security system, in order to realize university internal political, administrative, academic three decentralized governance, establish a corporate governance structure with the development of modern university.
