【摘要】：20世紀(jì)90年代,學(xué)術(shù)腐敗問題日益嚴(yán)重,人們開始關(guān)注學(xué)術(shù)腐敗現(xiàn)象,對(duì)學(xué)術(shù)腐敗的討論逐漸增多。進(jìn)入21世紀(jì),國家教育部、科技部等國家相關(guān)部門制定的預(yù)防和懲治學(xué)術(shù)腐敗的規(guī)章,加上原來知識(shí)產(chǎn)權(quán)法的相關(guān)規(guī)定,對(duì)于學(xué)術(shù)腐敗的治理起到了一定的作用。但學(xué)術(shù)腐敗現(xiàn)象不僅沒有減弱,相反愈演愈烈,大有星火燎原之勢(shì)。學(xué)術(shù)腐敗的案件層次越來越高,涉及的范圍越來越大。究其原因,既有外部環(huán)境因素,如各高校的科研數(shù)量指標(biāo)；監(jiān)管的薄弱；也有內(nèi)部原因,人心的浮躁,腐敗的低成本與高收益等。學(xué)術(shù)腐敗嚴(yán)重影響了學(xué)術(shù)創(chuàng)新能力的提升,影響了我國在國際上的學(xué)術(shù)創(chuàng)新競(jìng)爭(zhēng)力,更重要地是對(duì)社會(huì)造成了極壞的影響。如何應(yīng)對(duì)學(xué)術(shù)腐敗這一社會(huì)毒瘤,用法律來規(guī)制無疑是最基礎(chǔ)的手段。目前對(duì)于學(xué)術(shù)腐敗的法律規(guī)制研究的文章比較少,且系統(tǒng)性和理論性不夠,因此,有必要在梳理既有研究文獻(xiàn)的基礎(chǔ)上對(duì)預(yù)防和治理學(xué)術(shù)腐敗的法律問題進(jìn)行深入探究。 本文共分五章,引言介紹論文的選題意義和研究方法；第一章對(duì)學(xué)術(shù)腐敗的概念進(jìn)行界定；第二章介紹學(xué)術(shù)腐敗的歷史與現(xiàn)狀,考察了學(xué)術(shù)腐敗發(fā)展的歷史,并分析了學(xué)術(shù)腐敗產(chǎn)生的原因；第三章介紹國外學(xué)術(shù)腐敗治理的制度與經(jīng)驗(yàn),分析了美國、歐洲四個(gè)國家、亞洲的日本和韓國應(yīng)對(duì)學(xué)術(shù)腐敗的做法和經(jīng)驗(yàn)；第四章介紹了我國學(xué)術(shù)腐敗治理制度和實(shí)踐,學(xué)術(shù)道德、學(xué)術(shù)自律、行業(yè)管理等在學(xué)術(shù)腐敗預(yù)防和治理中的地位和作用；分析了我國學(xué)術(shù)腐敗法律治理的現(xiàn)狀和不足,并針對(duì)這種狀況,對(duì)法律規(guī)制學(xué)術(shù)腐敗現(xiàn)象進(jìn)行了如何完善的思考；第五章是結(jié)語,對(duì)全文進(jìn)行了總結(jié),并指出論文的局限與不足。 本論文的創(chuàng)新點(diǎn)在于,在梳理有關(guān)文獻(xiàn)的基礎(chǔ)上界定了學(xué)術(shù)腐敗的概念,構(gòu)建了廣義的學(xué)術(shù)腐敗的概念；在借鑒國外對(duì)學(xué)術(shù)腐敗治理的經(jīng)驗(yàn)和不違背國內(nèi)有關(guān)法律法規(guī)規(guī)章的基礎(chǔ)上構(gòu)建了預(yù)防和治理學(xué)術(shù)腐敗法律框架。 其局限與不足是,占有的文獻(xiàn)數(shù)量還不夠豐富,第一手文獻(xiàn)的資料較少；有些觀點(diǎn)還欠斟酌,語言表述不夠凝煉。
[Abstract]:In 1990s, the problem of academic corruption became more and more serious, people began to pay attention to the phenomenon of academic corruption, and the discussion of academic corruption gradually increased. The regulations on the prevention and punishment of academic corruption formulated by the Ministry of Science and Technology and other relevant state departments, together with the relevant provisions of the original intellectual property Law. For the governance of academic corruption has played a certain role. But the phenomenon of academic corruption not only has not weakened, on the contrary, become increasingly fierce, there is a great potential to start a prairie fire. The level of cases of academic corruption is getting higher and higher. The reason is that there are external environmental factors, such as the scientific research quantity index of colleges and universities; Weak regulation; There are internal reasons, impetuous people, low cost and high income of corruption. Academic corruption seriously affects the improvement of academic innovation ability and the competitiveness of our country in the international academic innovation. More importantly, it has a very bad impact on the society. How to deal with the social cancer of academic corruption, legal regulation is undoubtedly the most basic means. At present, there are few articles on the legal regulation of academic corruption. Therefore, it is necessary to probe into the legal problems of preventing and controlling academic corruption on the basis of combing the existing research literature. This paper is divided into five chapters, the introduction introduces the significance of the topic and research methods; The first chapter defines the concept of academic corruption; The second chapter introduces the history and present situation of academic corruption, examines the history of academic corruption development, and analyzes the causes of academic corruption. The third chapter introduces the system and experience of the management of academic corruption in foreign countries, and analyzes the practices and experiences of the United States, four European countries, Japan and Korea in Asia in dealing with academic corruption. Chapter 4th introduces the status and role of academic corruption management system and practice, academic morality, academic self-discipline and industry management in the prevention and management of academic corruption. This paper analyzes the current situation and shortcomings of the legal governance of academic corruption in China, and in view of this situation, gives some thoughts on how to perfect the legal regulation of the phenomenon of academic corruption; Chapter 5th is the conclusion, summarizes the full text, and points out the limitations and shortcomings of the paper. The innovation of this paper lies in the definition of the concept of academic corruption on the basis of combing the relevant literature, and the construction of the broad concept of academic corruption; On the basis of drawing lessons from the experience of foreign countries on the management of academic corruption and not violating the relevant domestic laws and regulations, the legal framework of preventing and controlling academic corruption is constructed. Its limitation and deficiency are that the quantity of literature is not rich enough, and the firsthand literature is less; some viewpoints are not considered, and the language is not condensed enough.
