【摘要】:懲罰作為一種教育手段在我國(guó)歷史悠久!兑捉(jīng)·系辭傳》曰:"小懲而大戒,此小人之福也。"《尚書(shū)·舜典》載有:"鞭作官刑,樸作教刑"!抖Y記·學(xué)記》亦有"夏楚二物,收其威也"的論述。今天,隨著社會(huì)民主化、教育法制化的加速和學(xué)生主體意識(shí)的加強(qiáng),人們不再對(duì)懲罰教育持一致肯定的態(tài)度。究其原因,是目前國(guó)內(nèi)的教育實(shí)踐中,存在著濫用體罰甚至造成傷害學(xué)生的違法事件和懼怕懲罰教育的負(fù)面影響而回避必要懲罰的現(xiàn)象;在法律的運(yùn)用上也存在學(xué)校規(guī)章與法律條文"打架"以及懲罰教育與侵犯人權(quán)二者之間難以區(qū)別和界定的困難。懲罰作為一種教育手段,是否還有存在的必要?如果有,那么在什么條件下可以運(yùn)用教育懲罰?如何掌握教育懲罰的力度和策略?這些都是廣大教師迫切需要弄清的問(wèn)題。為此,我們組織了"關(guān)于‘教育懲罰問(wèn)題’的探討"專題筆談,從教育、心理、法律等不同領(lǐng)域、不同視角對(duì)其進(jìn)行較為全面系統(tǒng)的深層次探討,意在引起廣大教師和教育理論工作者對(duì)此問(wèn)題的進(jìn)一步關(guān)注。
[Abstract]:Punishment, as a means of education, has a long history in our country. The Book of changes in the Book of changes preached: "small punishment and great precepts, this villain is also blessed." the Book of Shun in Shang Shu contains: "the whip is the official punishment, the simple one is the teaching punishment." the Book of Rites also contains "Xia Chu-II," The argument of "taking advantage of it". Today, with the democratization of the society, the acceleration of the legalization of education and the strengthening of the students' subjective consciousness, people no longer hold a unanimous attitude towards the punishment of education. The reason is that the abuse of corporal punishment and even harm to students in the current education practice, and fear of the negative impact of punishment education and avoid the phenomenon of necessary punishment; In the application of the law, there are also difficulties in distinguishing and defining school regulations and legal provisions, as well as in punishing education and violating human rights. Is there a need for punishment as a means of education? If so, under what conditions can educational penalties be applied? How to grasp the strength and strategy of education punishment? These are the most urgent problems teachers need to understand. To this end, we organized a special discussion on "on the question of punishment in Education", which was discussed in a more comprehensive and systematic way from different perspectives in different fields of education, psychology, law, etc. It is intended to attract further attention from teachers and educational theorists.
