實(shí)現(xiàn)義務(wù)教育公共服務(wù)均等化的三個(gè)分析維度——基于“權(quán)力—權(quán)利”關(guān)系協(xié)同的視角

【摘要】：義務(wù)教育公共服務(wù)均等化缺失問(wèn)題構(gòu)成對(duì)公民受教育權(quán)利的侵犯。要想實(shí)現(xiàn)義務(wù)教育公共服務(wù)均等化,需要在制衡公共權(quán)力基礎(chǔ)上促進(jìn)公共權(quán)力與公民權(quán)利的二者協(xié)同。為此,可以嘗試以公民權(quán)利分配廣度分散公共權(quán)力強(qiáng)度、整合公民個(gè)體權(quán)利為群體權(quán)利、以制度建設(shè)保障公民享受義務(wù)教育平等權(quán)利、提升公民權(quán)利意識(shí)等方式,以達(dá)到"以社會(huì)權(quán)力制衡國(guó)家權(quán)力"的目的;以完善公民本位義務(wù)教育法律體系、探索提升義務(wù)教育公共服務(wù)質(zhì)量的法律長(zhǎng)效機(jī)制、化解公民受教育權(quán)利救濟(jì)困境和建立訴訟救濟(jì)機(jī)制、推進(jìn)憲法司法化等方式,實(shí)現(xiàn)以法律保障公民平等享有教育權(quán)利的目標(biāo)。此外,加強(qiáng)義務(wù)教育經(jīng)費(fèi)預(yù)算民主建設(shè)也是實(shí)現(xiàn)義務(wù)教育公共服務(wù)均等化的重要途徑。
[Abstract]:The lack of equalization of public services in compulsory education constitutes an infringement of citizens' right to education. In order to realize the equalization of public service in compulsory education, it is necessary to promote the coordination between public power and civil right on the basis of check and balance of public power. Therefore, we can try to spread the intensity of public power with the distribution of civil rights, integrate the individual rights of citizens as group rights, guarantee the equal rights of citizens to enjoy compulsory education and raise the awareness of civil rights. In order to achieve the purpose of "balancing state power with social power", to perfect the legal system of citizen oriented compulsory education, to explore the long-term legal mechanism of improving the quality of compulsory education public service, In order to realize the goal of ensuring citizens' equal right to education by law, the relief predicament of citizens' right to receive education should be resolved and the relief mechanism of litigation should be set up, and the judicial system of constitution should be promoted. In addition, strengthening the democratic construction of compulsory education budget is also an important way to realize the equalization of compulsory education public services.
