【摘要】：19世紀末20世紀初,是清末實施“預(yù)備立憲”的時期,也是制定、頒布新法律的重要階段。這一時期,報紙已經(jīng)成為西方法文化傳播的重要載體。《申報》作為當時影響最大的報紙,其在完成自身的角色轉(zhuǎn)換之后,也積極投入到對當時法律教育改革的報道中,特別是對于法律變革中的碰撞作了大量的介紹、宣傳。《申報》通過欄目的設(shè)置加大了對法律改革的關(guān)注,其焦點也由原來的英美法系轉(zhuǎn)向大陸法系,傳播了大量的西方近代資產(chǎn)階級的法律思想、原則。同時通過刊登大量的司法案例,生動現(xiàn)實地傳播了西方資產(chǎn)階級的法律文化。重要的是,《申報》作為一扇了解清末法律教育改革的窗口,從社會輿論的角度積極參與了清末新法的制定和討論,一方面指出了清政府憲政和法制改革過程中的不足,另一方面對于新法的制定提出了許多積極合理的建議,有利地配合了清末的立憲運動和法制教育改革,向廣大民眾傳播了西方法律思想,起到了法律教育理念在大眾中的傳播作用。筆者選取了在當時的政界、知識界和下層民眾中具有較大影響的新式傳媒——《申報》作為自己的基本研究史料,試圖通過與官方正史、律令典章等資料的相互印證,從一個新的研究視角,探討清末司法改革在教育的具體實踐和《申報》所發(fā)揮的具體作用,試以彌補當前清末法律教育改革研究中存在的不足,并努力揭示出清末法律教育改革與《申報》之間的內(nèi)在聯(lián)系。
[Abstract]:The end of the 19th century and the beginning of the 20th century was the period of implementing the "preliminary constitution" in the late Qing Dynasty and the important stage of making and promulgating new laws. During this period, newspapers had become an important carrier for the dissemination of Western methods and culture. As the newspaper with the greatest influence at that time, after completing its role transformation, it also actively participated in the report on the reform of legal education at that time. In particular, a large number of introductions have been made to the collision in the legal reform, and propaganda. Through the setting of columns, the focus of the law reform has been increased, and its focus has also shifted from the original common law system to the civil law system. Spread a large number of Western modern bourgeoisie legal ideas, principles. At the same time, through the publication of a large number of judicial cases, vividly and realistically spread the legal culture of the Western bourgeoisie. Importantly, as a window to understand the reform of legal education in the late Qing Dynasty, the "declaration" actively participated in the formulation and discussion of the new laws of the late Qing Dynasty from the angle of public opinion. On the one hand, it pointed out the deficiencies in the process of the constitutional and legal reform of the Qing government. On the other hand, many positive and reasonable suggestions were put forward for the formulation of the new law, which was beneficial to the constitutionalism movement and the legal education reform in the late Qing Dynasty, and spread western legal thoughts to the general public. Played a role in the dissemination of legal education ideas in the public. The author chooses the new media, which has great influence among the political circles, the intellectuals and the lower class, as their basic research historical materials, and tries to confirm each other with official history, laws and regulations, etc. From a new perspective of research, this paper probes into the specific role of judicial reform in the education practice and declaration in the late Qing Dynasty, and tries to make up for the deficiency in the current research on the legal education reform in the late Qing Dynasty. And tries to reveal the legal education reform in the late Qing Dynasty and the internal relationship between the declaration.
