【摘要】：考試是人類特有的一種社會實踐活動,是一定的考試主體根據(jù)考試的目的和需要,選擇運用某種方式和手段,對考試客體的知識、能力、素質(zhì)等方面進行測量和鑒別的一種社會活動�？v觀世界教育發(fā)展史,考試已經(jīng)成為人才選拔和人力資源配置過程中不可或缺的重要組成部分。我國是世界上最早建立考試制度的國家,也是具有豐富考試經(jīng)驗和悠久考試文化的考試大國。隨著社會的發(fā)展,考試不僅僅是一項人才選拔制度,更成為涉及政治、經(jīng)濟、文化等各方面的一項社會制度。國家教育考試制度作為國家教育制度中的一個重要組成部分,在提高教育質(zhì)量和促進教育改革中發(fā)揮著舉足輕重的作用�！吨腥A人民共和國教育法》(以下簡稱《教育法》)第21條明確規(guī)定“國家實行教育考試制度”。然而,在教育考試占據(jù)如此重要地位的今天,我國卻存在著教育考試立法嚴重滯后,已有教育考試法律制度位階低下,沒有考試單行法律,教育立法內(nèi)容不全面等問題。因此,我們需要對國家教育考試立法的理論問題進行深入研究,豐富教育考試立法的相關(guān)理論,加強國家教育考試立法實踐,明確教育考試過程中政府以及其他各方主體的權(quán)利義務關(guān)系,制定專門的教育考試法律,使我國的國家考試立法具有系統(tǒng)性、權(quán)威性和實效性,為我國國家教育考試的健康發(fā)展提供法律保障。本論文主要從四個部分進行論述:第一部分在闡釋國家教育考試概念的基礎上分析了我國制定一部國家教育考試法的必要性及可行性;第二部分主要剖析了當前我國國家教育考試制度建設現(xiàn)狀及存在問題;第三部分論述了美國、英國和日本在教育考試方面的法律制度和相關(guān)規(guī)定,并提出對我國國家教育考試立法的啟示;第四部分在借鑒美國、英國和日本教育考試立法成功經(jīng)驗并結(jié)合我國實際的基礎上,對國家教育考試立法進行探索和思考,提出我國國家教育考試立法應當確立國家教育考試法律原則,充實國家教育考試立法內(nèi)容,強化國家教育考試法律監(jiān)督等方面的具體建議;最后,通過對國內(nèi)外教育考試立法理論進行系統(tǒng)研讀、梳理、比較和評析,結(jié)合我國教育發(fā)展和教育考試法律制度建設的實際需要,提出了制定《中華人民共和國教育考試法》(以下簡稱《教育考試法》)建議稿,為完善我國教育考試法律制度提供參考。
[Abstract]:Examination is a kind of social practice activity peculiar to human being. It is the knowledge and ability of a certain examination subject to use some way and means according to the purpose and need of the examination. A social activity in which quality is measured and identified. Throughout the history of education in the world, examination has become an indispensable part in the process of talent selection and human resource allocation. China is the first country in the world to establish an examination system, and is also a big country with rich examination experience and a long examination culture. With the development of society, examination is not only a talent selection system, but also a social system involving politics, economy, culture and so on. As an important part of the national education system, Article 21 of the Education Law of the people's Republic of China (hereinafter referred to as "Education Law") clearly stipulates that "the State implements the educational examination system". However, today, when the educational examination occupies such an important position, there are some problems in our country, such as the serious lag of the educational examination legislation, the low rank of the legal system of the educational examination, the absence of the single law of the examination, the incomplete content of the educational legislation, and so on. Therefore, we need to conduct in-depth research on the theoretical issues of national educational examination legislation, enrich the relevant theories of educational examination legislation, and strengthen the practice of national educational examination legislation. In order to make the national examination legislation systematic, authoritative and effective, we should make clear the relationship between the rights and obligations of the government and other parties in the process of educational examination, and formulate special laws on education examination. To provide the legal guarantee for the healthy development of the national education examination in our country. This paper mainly discusses from four parts: the first part analyzes the necessity and feasibility of making a national education examination law on the basis of explaining the concept of national education examination; The second part mainly analyzes the current situation and existing problems in the construction of national educational examination system in China. The third part discusses the legal system and related regulations of the United States, Britain and Japan in the field of educational examination. The fourth part explores and ponders the national education examination legislation on the basis of the successful experience of the United States, Britain and Japan and the actual situation of our country. The author puts forward some concrete suggestions on how to establish the legal principle of national education examination, enrich the content of national education examination legislation, strengthen the legal supervision of national education examination, etc. Through the systematic study, combing, comparison and evaluation of the domestic and foreign educational examination legislation theories, combining with the actual needs of our country's educational development and the construction of educational examination legal system, This paper puts forward some suggestions on the formulation of the Educational examination Law of the people's Republic of China (hereinafter referred to as the Educational examination Law), which provides a reference for perfecting the legal system of educational examination in China.
