【摘要】：著作權(quán)制度的宗旨是保護(hù)著作權(quán)人合法權(quán)益以促進(jìn)文學(xué)藝術(shù)的創(chuàng)作繁榮,推動(dòng)社會(huì)文明進(jìn)步。遵循利益平衡原則,在法律的框架下保護(hù)著作權(quán)人利益,避免著作權(quán)向公有領(lǐng)域擴(kuò)張,因此應(yīng)依法確定著作權(quán)的客體范圍,對(duì)于短語、口號(hào)、詞匯等公有領(lǐng)域的元素不予著作權(quán)保護(hù),確有獨(dú)創(chuàng)性的作品標(biāo)題、廣告語可以納入反不正當(dāng)競(jìng)爭(zhēng)法保護(hù)或作為作品保護(hù),但應(yīng)嚴(yán)格確定受保護(hù)的條件。
[Abstract]:The aim of copyright system is to protect the legitimate rights and interests of copyright owners, to promote the creation and prosperity of literature and art, to promote the progress of social civilization, to follow the principle of balance of interests and to protect the interests of copyright owners under the framework of law. To avoid the expansion of copyright to the public domain, the scope of the object of copyright should be determined according to law, and the elements in the public domain, such as phrases, slogans, vocabulary and so on, should not be protected by copyright, and there are indeed original titles of works. Advertising language can be protected by anti-unfair competition law or as work protection, but the conditions of protection should be strictly determined.
