Abstract: the administrative licensing is a frontier inspection organs of public security administrative mechanism of a kind of beforehand control, it is the public security organ to safeguard social public safety and social security order, according to the other party's application, after review, allow it to engaged in a particular activity or give their legal qualification and certification of administrative law. Public security frontier inspection organs compared with other administrative licensing, has its own uniqueness. Its development has experienced a long history, and with the changes in political, social and economic life, which mixed with many historical reasons and realistic problem, introduction of the "administrative licensing law", therefore, frontier inspection authorities permit system has its necessity and urgency of the research. Due to its wide range, variety, enactment right has been chaotic, frontier inspection organ shall study quite difficult. This article through to the national unity and in quite a number of provinces and cities to implement on the implementation of the typical permission by the frontier inspection organ to comb, to define its basic theory, analysis the existing problems and discusses the future development of the overall train of thought.

一、行政許可制度概述

行政相對(duì)人開辦企業(yè)，需要到工商管理機(jī)關(guān)辦理相關(guān)登記手續(xù)，獲得行政主體的批準(zhǔn)；企業(yè)生產(chǎn)與銷售產(chǎn)品，，需要獲得相關(guān)行政主管部門的批準(zhǔn)；工廠如要對(duì)污染物進(jìn)行排放，需要取得環(huán)保管理部門頒發(fā)的排污許可證，這些都是所謂的行政許可。而在實(shí)際的生活中由行政主體發(fā)放的證書名目繁多，某些活動(dòng)雖然是一種審批活動(dòng)，但并不一定是行政許可；而某些活動(dòng)雖沒假以行政許可之名，但在性質(zhì)上卻是行政許可。因此，行政許可的概念和性質(zhì)的研究對(duì)行政許可制度的分析研究有重要的意義和作用。
