隨著國家知識產權戰(zhàn)略的深入實施以及對外開放水平的不斷提高,我國越來越重視對外知識產權交流,特別是知識產權立法交流。由于英美國家在知識產權立法方面積聚了豐富經驗,知識產權立法文本翻譯研究可以為我國立法機關、行政部門、企業(yè)及法學研究人員提供基礎性參考資料,從而促進我國知識產權法律制度的完善,服務于創(chuàng)新型國家建設目標。本報告基于英國《1988年版權、外觀設計和專利法案》英漢翻譯實踐,以紐馬克的語義翻譯和交際翻譯為理論指導,嘗試解決知識產權立法文本英譯漢中的典型問題。作為法律文本的一種類型,知識產權立法文本包含大量法律術語、知識產權術語及模糊語,句型多為長難句及被動句,語篇結構嚴謹、風格莊重、邏輯嚴密。這些語言特征給翻譯工作帶來極大挑戰(zhàn),使譯者常面臨如下影響文本信息準確傳遞的問題:詞匯層面,法律術語、知識產權術語以及模糊語翻譯準確性欠佳;句法層面,長難句及被動句誤譯;篇章層面,語篇銜接不當,譯文語言風格不統(tǒng)一。紐馬克的語義翻譯和交際翻譯理論強調通過語義翻譯保留原文的語境意義,以交際翻譯來優(yōu)化文本信息內容的傳達、增強譯文可讀性。在紐馬克語義翻譯和交際翻譯理論的指導下,通過實施以下對策,可以有效解...
