收費公路運營主體與公眾的利益沖突問題研究

【摘要】:自采取貸款修路,,收費還貸政策以來,我國公路事業(yè)的發(fā)展取得了巨大成就。收費政策產(chǎn)生了收費公路。圍繞著收費公路存在著政府,運營主體和公眾三大利益體。三大利益體各自的利益訴求表現(xiàn)為:政府處于管理和協(xié)調(diào)的主導(dǎo)地位,應(yīng)以平衡收費公路的公益性和收益性為利益訴求;運營主體的利益訴求表現(xiàn)為收回建設(shè)運營成本之外還需獲得合理的回報;公眾利益訴求主要表現(xiàn)為在享受高速、便捷、人性化服務(wù)的交通的同時負擔合理的通行費。政府一方面要保證運營主體參與公共產(chǎn)品經(jīng)營的積極性,一方面又要照顧公眾的利益。由于運營主體的逐利性,其必然會導(dǎo)致與公眾利益的沖突,而地方政府青睞于收費的利益,其管制產(chǎn)生了缺位,導(dǎo)致公眾利益被嚴重侵犯。有些公眾反應(yīng)過激,甚至要求取消公路的收費。運營主體與公眾的利益沖突問題凸顯。 本文以收費公路運營主體和公眾之間的利益沖突問題為研究對象,展開了全文的論述。文章共分為六個部分:第一章為緒論,主要介紹了本文的研究背景和研究意義,研究思路方法,以及研究內(nèi)容,國內(nèi)外研究現(xiàn)狀等。第二章是研究的相關(guān)理論基礎(chǔ)。第三章介紹了收費公路運營主體和公眾利益沖突的現(xiàn)狀,包括其表現(xiàn)出的問題,原因,影響三個方面。第四章是關(guān)于國外協(xié)調(diào)收費公路運營主體與公眾利益沖突的經(jīng)驗與啟示。第五章對收費公路運營主體與公眾利益沖突的協(xié)調(diào)對策進行了探討。主要內(nèi)容包括沖突協(xié)調(diào)中要把握的原則,以及具體的協(xié)調(diào)對策。最后是結(jié)語及有待進一步研究的問題。
[Abstract]:Since the policy of loan repair and toll service has been adopted, great achievements have been made in the development of highway industry in our country. The toll policy gave rise to toll roads. There are three main interests of the government, the main body of operation and the public around the toll road. The interest demands of the three major interest bodies are as follows: the government is in the dominant position of management and coordination, which should balance the public welfare and profitability of toll roads as the interest demands; the interest demands of the main body of operation show that reasonable returns should be obtained in addition to the recovery of construction operating costs; and the public interest demands are mainly manifested in the enjoyment of high-speed, convenient and humanized traffic while bearing reasonable tolls. On the one hand, the government should ensure the enthusiasm of the operators to participate in the management of public goods, on the other hand, it should take care of the interests of the public. Because of the profit-seeking of the operation subject, it will inevitably lead to the conflict with the public interest, and the local government favours the interest of charging, and its control has been absent, which leads to the serious infringement of the public interest. Some members of the public have overreacted and even called for the abolition of road tolls. The conflict of interest between the operating subject and the public is prominent. In this paper, the conflict of interest between the main body of toll road operation and the public is taken as the research object, and the full text is discussed in this paper. The article is divided into six parts: the first chapter is the introduction, mainly introduces the research background and significance of this paper, research ideas and methods, as well as research content, research status at home and abroad. The second chapter is the relevant theoretical basis of the study. The third chapter introduces the present situation of the conflict of interest between the main body of toll road operation and the public, including the problems, causes and effects of toll road operation. The fourth chapter is about the experience and enlightenment of coordinating the conflict of public interest between the main body of toll road operation and the public interest in foreign countries. The fifth chapter discusses the coordinated countermeasures of the conflict of interest between the main body of toll road operation and the public. The main contents include the principles to be grasped in conflict coordination, as well as the specific coordination countermeasures. Finally, the conclusion and the problems to be further studied.
