廣東省海事管理現(xiàn)狀與對(duì)策研究

【摘要】：在廣東省,由于其經(jīng)濟(jì)發(fā)展水平和特殊的管理水域、港口建設(shè)以及水上交通運(yùn)輸?shù)男问?海洋經(jīng)濟(jì)是舉足輕重的經(jīng)濟(jì)發(fā)展領(lǐng)域。近年來(lái)隨著廣東海洋經(jīng)濟(jì)發(fā)展戰(zhàn)略的確定,沿海港口和內(nèi)河航運(yùn)將迎來(lái)新一輪的快速規(guī)劃發(fā)展期,屆時(shí)轄區(qū)水上安全及溢油風(fēng)險(xiǎn)不斷加大,社會(huì)公眾對(duì)安全和環(huán)保的訴求不斷提高,履行國(guó)際公約與維護(hù)國(guó)家權(quán)益責(zé)任日益加重,海事管理作為保障海洋經(jīng)濟(jì)健康、快速、穩(wěn)定發(fā)展是一項(xiàng)至關(guān)重要的行政職能。廣東海事局作為保障廣東省轄區(qū)水上交通安全、高效的主要職能部門(mén),一方面擔(dān)負(fù)著保障航行安全,保護(hù)海洋環(huán)境、便利水上運(yùn)輸、維護(hù)國(guó)家權(quán)益的神圣職責(zé),另一方面又在服務(wù)區(qū)域社會(huì)經(jīng)濟(jì)發(fā)展中承擔(dān)重要的角色,是海事系統(tǒng)分支機(jī)構(gòu)最多、功能較為全面的直屬海事局。在近年廣東海事管理面臨攤子大、戰(zhàn)線長(zhǎng)、業(yè)務(wù)全和任務(wù)重等特點(diǎn)的情況下,廣東海事局不斷探索海事管理的新方法和新技術(shù),力圖提高海事管理效率,提升海事管理水平。 本文通過(guò)對(duì)新公共服務(wù)理論、整體性治理理論、網(wǎng)絡(luò)化治理模式和信息化背景下一站式政府服務(wù)理論的解讀,結(jié)合廣東省海事部門(mén)的實(shí)際情況,針對(duì)廣東省海事管理實(shí)踐中的問(wèn)題提出建設(shè)性的改進(jìn)措施。 本文主要分為五個(gè)部分。第一部分是闡述問(wèn)題的提出與選題的意義、相關(guān)學(xué)者的研究現(xiàn)狀和論文的內(nèi)容與結(jié)構(gòu)安排。第二部分是對(duì)海事管理職能相關(guān)概念和理論的闡釋,為海事管理職能的健全優(yōu)化提供理論基礎(chǔ)。第三部分是對(duì)西方發(fā)達(dá)國(guó)家典型海事管理的先進(jìn)工作經(jīng)驗(yàn)進(jìn)行描述和分析,主要包括英國(guó)、美國(guó)和北歐各國(guó)的海事管理現(xiàn)狀,通過(guò)對(duì)現(xiàn)狀的分析總結(jié),概括西方國(guó)家的典型海事管理經(jīng)驗(yàn)為廣東海事管理提供借鑒。第四部分是對(duì)我國(guó)廣東省海事管理的現(xiàn)狀和存在問(wèn)題進(jìn)行分析論述,對(duì)目前海事管理過(guò)程中存在的問(wèn)題進(jìn)行分類概括,主要包括組織體系復(fù)雜權(quán)力分散,管制主義嚴(yán)重服務(wù)理念缺乏,預(yù)警應(yīng)急系統(tǒng)的落后,缺乏社會(huì)組織和公民對(duì)海事管理的參與,海事管理電子政務(wù)的構(gòu)建不完善,法律法規(guī)的不健全等問(wèn)題。第五部分是為廣東海事管理的改革提供對(duì)策和建議,在廣東海事管理職能的基礎(chǔ)上,強(qiáng)化海事管理的服務(wù)意識(shí),提升服務(wù)水平；對(duì)海事管理部門(mén)進(jìn)行整體性治理使其管理結(jié)構(gòu)趨于合理化；海事管理應(yīng)急預(yù)警系統(tǒng)的不斷加強(qiáng)和完善；對(duì)海事管理電子信息系統(tǒng)的充分有效利用；對(duì)海事管理法律法規(guī)的健全和完善。 廣東海事管理作為政府職能的重要一環(huán),是適應(yīng)海洋經(jīng)濟(jì)不斷發(fā)展完善,加快海事管理機(jī)構(gòu)自身轉(zhuǎn)變和海事管理職能不斷優(yōu)化的所需要的。如何構(gòu)建最優(yōu)的海事管理機(jī)構(gòu),怎樣才能使海事管理機(jī)構(gòu)發(fā)揮最大的效用,使得一個(gè)服務(wù)意識(shí)不斷增強(qiáng),技術(shù)手段日益先進(jìn)完善,行政能力不斷提高的海事管理機(jī)構(gòu)日臻成熟,是一個(gè)具有深刻實(shí)踐和理論意義的選題。
