我國(guó)收費(fèi)公路行政管理制度研究

【摘要】:收費(fèi)公路的行政管理制度,是政府及其授權(quán)組織依據(jù)國(guó)家行政政策與規(guī)范,對(duì)收費(fèi)公路實(shí)施管理的實(shí)體制度與程序制度總稱,也是國(guó)家行政權(quán)在收費(fèi)公路管理中的重要體現(xiàn)與有效延伸。收費(fèi)公路的行政制度,源于我國(guó)公路融投資管理體制改革發(fā)展,涉及諸如籌集公路建設(shè)的資金制度,以及合法、有效保護(hù)公路經(jīng)營(yíng)權(quán)的行政制度,還包括公路收費(fèi)權(quán)的合法轉(zhuǎn)讓、使用制度,保護(hù)公路的國(guó)有資產(chǎn)權(quán)益等行政制度。分析與回顧我國(guó)收費(fèi)公路的行政管理沿革,厘清其行政制度與權(quán)屬特征,探討其行政組織制度、行政監(jiān)督制度及行政調(diào)控制度,是探索完善收費(fèi)公路行政管理關(guān)系與行政制度的基礎(chǔ)工作。 開展收費(fèi)公路行政制度的研究,離不開行政管理學(xué)理的支撐與科學(xué)方法的把握。以我國(guó)收費(fèi)公路行政管理制度為研究對(duì)象,運(yùn)用行政管理學(xué)、公共管理學(xué)理論,汲取政治學(xué)和法理學(xué)的有益營(yíng)養(yǎng),通過文獻(xiàn)分析法、調(diào)查研究方法、定性與定量的分析比較方法,從收費(fèi)公路的發(fā)展歷程、行政執(zhí)法,以及技術(shù)行政三個(gè)角度,對(duì)收費(fèi)公路管理制度進(jìn)行問題發(fā)掘與規(guī)律總結(jié),是本論文研究的方法論特點(diǎn)。 本文在研究前人成果的基礎(chǔ)上,就收費(fèi)公路行政管理制度的現(xiàn)狀、發(fā)展脈絡(luò)予以概括,,以促進(jìn)收費(fèi)公路可持續(xù)和科學(xué)發(fā)展為目的,提出了完善我國(guó)收費(fèi)公路行政管理制度的對(duì)策建議。 收費(fèi)公路的行政管理制度,是我國(guó)公路交通行政管理制度的重要組成部分。收費(fèi)公路行政的規(guī)范化與制度化,對(duì)于優(yōu)化收費(fèi)公路的行政管理制度體系,促進(jìn)公路行政制度的科學(xué)化具有積極意義。
[Abstract]:The administrative management system of toll roads is the entity system and procedure system that the government and its authorized organizations implement the management of toll roads according to the national administrative policies and norms. It is also an important embodiment and effective extension of state administrative power in toll road management. The administrative system of toll roads stems from the reform and development of the highway financing and investment management system in China, which involves, for example, the system of raising funds for highway construction, as well as the administrative system that legally and effectively protects the right to operate highways. It also includes the legal transfer of highway charge right, the system of using, and the administrative system of protecting the rights and interests of state-owned assets of highway. This paper analyzes and reviews the history of administrative management of toll roads in China, clarifies its administrative system and ownership characteristics, and probes into its administrative organization system, administrative supervision system and administrative regulation and control system. It is the basic work of exploring and perfecting the relationship between administrative management and administrative system of toll roads. The research on the administrative system of toll roads can not be carried out without the support of administrative management and the grasp of scientific methods. Taking the administrative management system of toll roads in our country as the object of study, using the theories of administrative management and public management, drawing on the beneficial nutrition of political science and jurisprudence, the paper investigates the research methods through the method of literature analysis. Qualitative and quantitative analysis and comparison methods, from the development of toll roads, administrative law enforcement, and technical administration of three angles, the toll road management system to explore and summarize the law, is the methodological characteristics of this paper. Based on the study of the previous achievements, this paper summarizes the current situation and development of the toll road administration system in order to promote the sustainable and scientific development of the toll road. The countermeasures and suggestions for perfecting the administrative system of toll roads in China are put forward. The administrative management system of toll road is an important part of highway traffic administration system in China. The standardization and institutionalization of toll road administration has positive significance for optimizing the system of administrative management of toll road and promoting the scientific system of highway administration system.
