分享經(jīng)濟(jì)時(shí)代政府監(jiān)管方式的創(chuàng)新路徑——以網(wǎng)約車新政為例

【摘要】:政府擁有公共道路資源經(jīng)營(yíng)和監(jiān)管"合二為一"的特權(quán),強(qiáng)化了出租車監(jiān)管預(yù)期租金收益和在準(zhǔn)租金分配中的剩余控制權(quán),而政府與平臺(tái)公司之間的信息不對(duì)稱,造成政府難以達(dá)到合意的監(jiān)管效果;網(wǎng)約車監(jiān)管新政仍然沿襲了傳統(tǒng)巡游車過度依賴行政許可的"公序"監(jiān)管方式,致使監(jiān)管新政成為傳統(tǒng)出租車的政策庇護(hù),難以擺脫諾斯悖論和管制俘獲。針對(duì)平臺(tái)公司搭建的雙邊市場(chǎng)特性,政府需要適度弱化"公序"監(jiān)管的剛性,以包容的態(tài)度充分發(fā)揮"私序"監(jiān)管的輔助作用,最終實(shí)現(xiàn)"公序"與"私序"監(jiān)管的兼容。為了更好地發(fā)展分享經(jīng)濟(jì),就監(jiān)管方式創(chuàng)新提出五點(diǎn)政策建議:一是堅(jiān)持對(duì)分享經(jīng)濟(jì)身份認(rèn)同、包容發(fā)展的態(tài)度;二是探索智能化監(jiān)管;三是探索專業(yè)化監(jiān)管;四是堅(jiān)持監(jiān)管的公益性;五是加強(qiáng)網(wǎng)絡(luò)化治理。
[Abstract]:The government has the privilege of "merging" the public road resource management and supervision, which strengthens the expected rental income and the residual control right in the quasi-rent distribution, and the information asymmetry between the government and the platform company. As a result, it is difficult for the government to achieve the desired regulatory effect; the New deal for the Regulation of car rides still follows the traditional "public order" mode of overreliance on administrative licenses for cruise vehicles, which has led to the new policy of regulating new regulations to become a policy shelter for traditional taxis. It is difficult to get rid of the North paradox and control capture. In view of the bilateral market characteristics of platform companies, the government needs to weaken the rigidity of "public order" supervision, give full play to the auxiliary role of "private order" supervision, and finally realize the compatibility between "public order" and "private order" supervision. In order to develop the sharing economy better, the paper puts forward five policy suggestions on the innovation of supervision mode: one is to insist on the attitude of identity of sharing economy, the other is to explore intelligent supervision, and the third is to explore specialized supervision. Fourth, adhere to the public welfare of supervision; fifth, strengthen network governance.
