【摘要】：城市公共交通屬于城市公用事業(yè),提供的是公共服務(wù)。在市場(chǎng)化改革的浪潮下,我國(guó)的城市公交企業(yè)開始了特許經(jīng)營(yíng)制度的改革。城市公交特許經(jīng)營(yíng)的企業(yè)既是生產(chǎn)企業(yè)又含有公益性質(zhì),由于低票價(jià)的管制和所承擔(dān)的公益性指令等任務(wù),城市公交特許企業(yè)存在政策性虧損。為了保證公交特許企業(yè)的正常運(yùn)營(yíng),維護(hù)市民的出行任務(wù),政府需要對(duì)公交企業(yè)的政策性虧損進(jìn)行行政補(bǔ)貼。在我國(guó)現(xiàn)有的公交補(bǔ)貼機(jī)制下,由于行政補(bǔ)貼法律制度的不健全,導(dǎo)致了補(bǔ)貼效果不明顯。因此,城市公共交通行政補(bǔ)貼機(jī)制的設(shè)計(jì)成為現(xiàn)階段城市公共交通發(fā)展中的重點(diǎn)問題。 文章的第一部分介紹了公交特許經(jīng)營(yíng)改革的興起,以十堰市的公交特許改革為例,指出了我國(guó)現(xiàn)行城市公交特許經(jīng)營(yíng)中行政補(bǔ)貼機(jī)制的不完善是導(dǎo)致公交特許經(jīng)營(yíng)改革失敗的一個(gè)重要的原因。 文章的第二部分分析了行政補(bǔ)貼的內(nèi)涵以及城市公共交通特許經(jīng)營(yíng)中行政補(bǔ)貼的理論基礎(chǔ),認(rèn)為規(guī)制性征收理論是城市公交特許經(jīng)營(yíng)者獲得行政補(bǔ)貼的理論基礎(chǔ),基于對(duì)特許權(quán)人財(cái)產(chǎn)利益的保護(hù),應(yīng)當(dāng)對(duì)其進(jìn)行行政補(bǔ)貼。 文章的第三部分從北京、深圳和南京的現(xiàn)行城市公交行政補(bǔ)貼實(shí)踐入手,指出了我國(guó)現(xiàn)階段城市公交行政補(bǔ)貼中存在的補(bǔ)貼法律層級(jí)過低、補(bǔ)貼的提供對(duì)象狹窄、補(bǔ)貼的形式過于單一、補(bǔ)貼的程序不夠統(tǒng)一明確、補(bǔ)貼的標(biāo)準(zhǔn)不利于權(quán)利人的保護(hù)以及補(bǔ)貼的法律救濟(jì)中缺乏給付訴訟的規(guī)定等問題。然后在借鑒了其他國(guó)家和地區(qū)城市公交特許經(jīng)營(yíng)中的行政補(bǔ)貼制度的先進(jìn)經(jīng)驗(yàn)的基礎(chǔ)之上,提出了我國(guó)城市公交特許經(jīng)營(yíng)中的行政補(bǔ)貼法律制度的完善建議：提出要從法律法規(guī)的層面上對(duì)行政補(bǔ)貼的實(shí)體權(quán)利和程序作出具體的規(guī)定、要建立完善的特許經(jīng)營(yíng)準(zhǔn)入制度、擴(kuò)大行政補(bǔ)貼的形式、建立統(tǒng)一完備的補(bǔ)貼程序、以完全補(bǔ)貼為標(biāo)準(zhǔn)對(duì)特許權(quán)人進(jìn)行補(bǔ)貼以及在行政訴訟中引入給付訴訟的內(nèi)容這些方面來完善目前的城市公交特許經(jīng)營(yíng)中的行政補(bǔ)貼制度。
[Abstract]:Urban public transport belongs to urban public utilities and provides public services. In the tide of market-oriented reform, urban transit enterprises in China began the reform of franchise management system. The enterprise of urban public transport franchise is not only a production enterprise but also a commonweal enterprise. Due to the control of low fares and the tasks of public welfare, the urban public transport concession enterprise has policy losses. In order to ensure the normal operation of public transport concession enterprises and maintain the public travel tasks, the government needs to carry out administrative subsidies to the policy losses of public transport enterprises. Under the existing public transport subsidy mechanism in our country, the effect of subsidy is not obvious because the legal system of administrative subsidy is not perfect. Therefore, the design of administrative subsidy mechanism of urban public transport has become a key issue in the development of urban public transport. The first part of the article introduces the rise of public transport franchise reform, taking Shiyan city as an example. It is pointed out that the imperfection of the administrative subsidy mechanism in the current urban public transport franchise is an important reason for the failure of the reform of the public transport franchise. The second part of the article analyzes the connotation of administrative subsidies and the theoretical basis of administrative subsidies in urban public transport franchising, and holds that the theory of regulatory expropriation is the theoretical basis for urban public transport franchisees to obtain administrative subsidies. Based on the protection of the property interests of the concessionaire, administrative subsidies should be made to them. The third part of the article starts with the current practice of urban transit administrative subsidy in Beijing, Shenzhen and Nanjing, and points out that the legal level of subsidy is too low and the object of subsidy is narrow. The form of subsidy is too single, the procedure of subsidy is not uniform and clear, the standard of subsidy is not conducive to the protection of the obligee and the stipulation of litigation of payment is lacking in the legal relief of subsidy. Then, on the basis of learning from the advanced experience of the administrative subsidy system in the urban public transport franchise in other countries and regions, This paper puts forward some suggestions on how to perfect the legal system of administrative subsidy in the course of urban public transport franchise in our country. It puts forward that the substantive rights and procedures of administrative subsidy should be specified from the level of laws and regulations, and that a perfect admission system of franchise should be established. To expand the form of administrative subsidies and establish a unified and complete subsidy procedure, In order to perfect the current administrative subsidy system of urban public transport franchise, the concessionaire is subsidized according to the standard of complete subsidy and the content of payment lawsuit is introduced into the administrative litigation.
