我國(guó)內(nèi)河船員權(quán)益保障問(wèn)題研究

【摘要】:船員權(quán)益保障的問(wèn)題,是由船員的職業(yè)特殊性和行業(yè)的特殊行所決定的。文章對(duì)比了國(guó)內(nèi)外內(nèi)河船員發(fā)展過(guò)程中權(quán)益保障問(wèn)題的現(xiàn)狀,同時(shí)也對(duì)比了《中華人民共和國(guó)船員條例》實(shí)施前后我國(guó)內(nèi)河船員權(quán)益保障標(biāo)準(zhǔn)執(zhí)行情況:從船員收入、船員維權(quán)、法律地位、船員管理等方面變化情況,以量化的方式分析了內(nèi)河船員權(quán)益保障,一是結(jié)合我國(guó)內(nèi)河船員維權(quán)的意識(shí)的現(xiàn)狀分析、維權(quán)的途經(jīng)和手段研究;二是結(jié)合我國(guó)內(nèi)河船員勞工的現(xiàn)狀,認(rèn)真分析我國(guó)保障船員權(quán)益的法律體系是否健全,《勞動(dòng)法》和《中華人民共和國(guó)船員條例》的概括性規(guī)定是否具有可操作性和合理性,法規(guī)中的船員權(quán)益維護(hù)的主管機(jī)關(guān)的的責(zé)任和權(quán)力是否對(duì),主管機(jī)關(guān)的干預(yù)手段的有效性;三是對(duì)保障船員權(quán)益的的一些公共政策、管理機(jī)構(gòu)健全、管理體制完善方面進(jìn)行分析,并對(duì)我國(guó)在實(shí)施《中華人民共和國(guó)船員條例》法規(guī)的力度和深度進(jìn)行客觀評(píng)價(jià)。 借鑒一些船員維權(quán)的成功案例,針對(duì)我國(guó)內(nèi)河船員勞工政策提出一些意見和建議,對(duì)《中華人民共和國(guó)船員條例》的實(shí)施細(xì)則進(jìn)行政策上的分析和建議。首先從保障船員合法權(quán)益出發(fā),積極探索如何培養(yǎng)和使用高素質(zhì)船員,從而豐富人力資源管理理論。其次從多個(gè)角度分析我國(guó)內(nèi)河船員保護(hù)政策的制定和實(shí)施,以及對(duì)政策效果評(píng)估討論,從而豐富了公共政策分析理論。三對(duì)政府治理和部門的行政管理進(jìn)行研究,從而豐富了行政管理理論。同時(shí)分析總結(jié)我國(guó)內(nèi)河船員權(quán)益保障問(wèn)題與當(dāng)?shù)亟?jīng)濟(jì)發(fā)展和社會(huì)穩(wěn)定的重要聯(lián)系,運(yùn)用系統(tǒng)管理理論、公共政策分析原理、公共管理論等對(duì)履約中遇到的問(wèn)題進(jìn)行研究分析。對(duì)提高《船員條例》在我國(guó)內(nèi)河船員管理的實(shí)施力度和深度,建立完善的我國(guó)勞務(wù)市場(chǎng)規(guī)范機(jī)制,建立完善我國(guó)內(nèi)河船員勞工權(quán)益保障體系等提出合理建議。
[Abstract]:The security interests of the crew, the crew is decided by the special occupation particularity and industry. The status of rights at home and abroad in the process of the development of inland crew security problems are analyzed and also compared with the "People's Republic of China crew Ordinance before and after the implementation of the inland river, the crew to protect the rights and interests of the implementation of standards: income from the crew, the rights, legal status, the change of crew management, the way to quantify the analysis of inland river seafarers rights protection, one is with the analysis of status quo of China's inland crew awareness of rights, rights of means and ways; the two is a combination of the status quo of China's inland crew labor, a careful analysis of China's protection of the interests of the crew the legal system is sound," if the general provisions of labor law "and" People's Republic of China crew Ordinance has maneuverability and rationality, and the interests of the crew The authorities maintain the responsibility and authority of the competent authorities on whether, effective means of intervention; three is to protect the interests of the crew of the public policy, sound management, perfect management system is analyzed, and our objective evaluation in People's Republic of China Implementation Regulations on the regulations of the crew strength and depth.
From the successful case of some crew rights, according to China's inland crew labor policies put forward some opinions and suggestions, the detailed rules for the implementation of the regulations on the "People's Republic of China crew were analyzed and suggestions on policies. Firstly, safeguard the legitimate rights and interests of the crew, and actively explore how to develop and use high-quality crew, so as to enrich the theory of human resource management. Secondly, analysis the formulation and implementation of China's inland crew protection policy from many angles, and the policy effect evaluation is discussed, so as to enrich the theory of public policy analysis. Research on government governance and three administrative departments, so as to enrich the theory of administration. At the same time the connection analysis summary of China's inland crew to protect the interests of the local economy and development and social stability, the use of the system management theory, principle of public policy analysis, public management theory of performance in In order to improve the strength and depth of seafarers' management in China's inland waters, we should set up a complete standard mechanism of labor market in China, and establish and perfect the safeguard system of labor rights and interests of inland sailors.
