【摘要】：隨著我國(guó)經(jīng)濟(jì)快速增長(zhǎng)，道路貨物運(yùn)輸量的不斷增加，道路運(yùn)輸中超載現(xiàn)象普遍存在。在信息不對(duì)稱、結(jié)構(gòu)分散的道路貨運(yùn)市場(chǎng)中，超載運(yùn)輸以非法途徑提高車輛實(shí)載率獲取非法利潤(rùn)，擾亂道路貨運(yùn)市場(chǎng)秩序，產(chǎn)生極大負(fù)外部性的同時(shí)客觀上提高了貨物運(yùn)輸量，一定程度滿足當(dāng)今社會(huì)經(jīng)濟(jì)發(fā)展對(duì)物資流通的需求。國(guó)務(wù)院發(fā)布《關(guān)于加強(qiáng)道路交通安全工作的意見》中稱將研究超載運(yùn)輸列入刑事處罰范疇以保障道路安全暢通。在這種政策背景下系統(tǒng)分析超載入刑對(duì)我國(guó)道路貨運(yùn)經(jīng)濟(jì)系統(tǒng)的影響與效用有著重要的研究?jī)r(jià)值。 本文通過分析道路運(yùn)輸經(jīng)濟(jì)系統(tǒng)經(jīng)濟(jì)、法律、社會(huì)三個(gè)層面的主要構(gòu)成要素，，分析超載入刑實(shí)施對(duì)各個(gè)要素的效用及影響。從經(jīng)濟(jì)視角看，雖然超載入刑能加快貨運(yùn)市場(chǎng)組織與結(jié)構(gòu)的調(diào)整，但是一定程度影響了道路運(yùn)輸市場(chǎng)的供需平衡，不利于現(xiàn)階段我國(guó)物資流通與經(jīng)濟(jì)的發(fā)展。從法律視角看，超載入刑有利于維護(hù)道路貨運(yùn)市場(chǎng)秩序。從社會(huì)視角看，超載入刑能降低道路貨運(yùn)外部性，有利于社會(huì)可持續(xù)發(fā)展。最后總結(jié)得出對(duì)于我國(guó)現(xiàn)階段國(guó)情應(yīng)審慎超載入刑的法規(guī)出臺(tái)，目前還不宜將超載列入刑事處罰范疇。
[Abstract]:With the rapid economic growth of our country and the increasing of road cargo traffic, the phenomenon of overloading in road transportation is widespread. In the road freight market with asymmetric information and decentralized structure, Overloading traffic increases the actual vehicle load rate by illegal means to obtain illegal profits, disrupts the order of the road freight market, produces a great deal of negative externalities, and objectively increases the volume of cargo transport. To a certain extent, it meets the demand of material circulation for social and economic development. The State Council said in its opinion on strengthening Road Traffic Safety that the study of overloading transportation should be included in the scope of criminal punishment to ensure road safety and smooth. Under this policy background, it is of great value to study the impact and utility of overloading penalty on the economic system of road freight transport in China. By analyzing the main elements of economic system, law and society of road transportation, this paper analyzes the utility and influence of the implementation of overloading penalty on each element. Although overloading punishment can speed up the adjustment of the organization and structure of the freight transport market, to a certain extent, it affects the balance of supply and demand in the road transport market, which is not conducive to the circulation of goods and the development of the economy in our country at the present stage. Overloading penalty is helpful to maintain the order of road freight transport market. From a social perspective, overloading penalty can reduce the externality of road freight transport. It is beneficial to the sustainable development of society. Finally, it is concluded that it is not appropriate to include overloading into the category of criminal punishment for the present situation of our country should be prudently overloaded.
