【摘要】：隨著中國鐵路"走出去"戰(zhàn)略的深入推進(jìn),企業(yè)知識產(chǎn)權(quán)保護(hù)和戰(zhàn)略意識也隨之提高。為了保護(hù)我國高速鐵路自主創(chuàng)新成果,提高鐵路企業(yè)的知識產(chǎn)權(quán)風(fēng)險(xiǎn)防控能力,結(jié)合我國高速鐵路技術(shù)特點(diǎn)和發(fā)展需要,提出高速鐵路專利預(yù)警機(jī)制目標(biāo)和機(jī)構(gòu)設(shè)置原則,構(gòu)建專利技術(shù)檢索、專利風(fēng)險(xiǎn)評估、專利風(fēng)險(xiǎn)告警、風(fēng)險(xiǎn)應(yīng)對控制等環(huán)節(jié)的高速鐵路專利預(yù)警運(yùn)行機(jī)制,并針對高速鐵路技術(shù)可能面臨的侵權(quán)風(fēng)險(xiǎn),提出專利風(fēng)險(xiǎn)防御、侵權(quán)訴訟抗辯、敗訴應(yīng)對等策略,為我國鐵路企業(yè)開展國內(nèi)外專利預(yù)警工作提供借鑒和參考。
[Abstract]:With the further development of the "going out" strategy of Chinese railway, the intellectual property protection and strategic consciousness of enterprises have also been raised. In order to protect the independent innovation achievements of high-speed railway in China and to improve the capability of intellectual property risk prevention and control of railway enterprises, According to the technical characteristics and development needs of high-speed railway in China, the paper puts forward the goal of patent early-warning mechanism and the principles of setting up institutions for high-speed railway, and sets up patent technology retrieval, patent risk assessment, patent risk warning, etc. The operation mechanism of patent early warning for high-speed railway in risk response and control, and the strategies of patent risk defense, infringement lawsuit defense, failure response and so on are put forward in view of the infringement risk that high-speed railway technology may face. It provides reference and reference for railway enterprises in China to carry out patent warning work at home and abroad.
