【摘要】:為了促進(jìn)我國(guó)高速鐵路建設(shè)的可持續(xù)發(fā)展,高鐵站區(qū)綜合開發(fā)被寄予厚望。在鐵路部門體制改革和國(guó)家政策支持的背景下,高鐵站區(qū)綜合開發(fā)依然進(jìn)展較為緩慢。因此,探討造成我國(guó)高鐵站區(qū)綜合開發(fā)難以實(shí)現(xiàn)的原因,成為急需解決的問題。通過對(duì)現(xiàn)有研究的梳理總結(jié),本文發(fā)現(xiàn),高鐵站區(qū)綜合開發(fā)中土地增值收益分配機(jī)制的不完善是阻礙高鐵站區(qū)綜合開發(fā)的主要原因之一。在文獻(xiàn)綜述基礎(chǔ)之上,本文試圖探討現(xiàn)行制度下我國(guó)大城市高鐵站區(qū)綜合開發(fā)過程中土地增值的形成與分配。本文發(fā)現(xiàn),現(xiàn)行制度下,假設(shè)我國(guó)建設(shè)用地使用權(quán)分層劃分制度已經(jīng)完善,既有高速鐵路站區(qū)綜合開發(fā)過程中土地增值收益分配對(duì)地方政府而言不公平,新建高速鐵路站區(qū)綜合開發(fā)過程中土地增值收益分配對(duì)鐵路主體而言不公平,而缺少土地增值收益公平分配的機(jī)制阻礙了我國(guó)大城市高鐵站區(qū)綜合開發(fā)。然后,本文系統(tǒng)整理并比較了國(guó)內(nèi)外高速鐵路(軌道交通)站區(qū)綜合開發(fā)中的土地增值收益分配機(jī)制。最后,本文結(jié)合我國(guó)當(dāng)下的現(xiàn)實(shí)情景,從中選取了適合的完善我國(guó)大城市高鐵站區(qū)綜合開發(fā)過程中土地增值收益分配機(jī)制的辦法。關(guān)于我國(guó)大城市既有高速鐵路站區(qū)綜合開發(fā)中土地增值收益分配機(jī)制,近期可采用地方政府和鐵路主體共同參與土地開發(fā)并共享土地開發(fā)環(huán)節(jié)的增值收益的方式,遠(yuǎn)期在鐵路主體具備開發(fā)能力后,可采用鐵路主體在負(fù)責(zé)公共配套設(shè)施建設(shè)或繳納一定的配套費(fèi)用后自主開發(fā)的方式。關(guān)于我國(guó)大城市新建高速鐵路站區(qū)綜合開發(fā)中土地增值收益分配機(jī)制,近期宜采用稅收返還方式,其可細(xì)分為兩種方式,一是地方政府將稅收返還給鐵路主體,二是合理確定高鐵站區(qū)沒建高鐵時(shí)的平均地價(jià)、再將土地出讓金中多出部分返還給鐵路主體;遠(yuǎn)期在鐵路主體具備開發(fā)能力后,可采用通過確定周邊土地沒建高鐵時(shí)的區(qū)域平均地價(jià),以此價(jià)格將周邊土地使用權(quán)出讓給軌道主體,由鐵路主體自主開發(fā)或與開發(fā)商合作開發(fā)的方式。
[Abstract]:In order to promote the sustainable development of high-speed railway construction in China, the comprehensive development of high-speed railway stations is highly expected. The comprehensive development of high-speed railway station area is still slow. Therefore, it is an urgent problem to explore the reasons why the comprehensive development of high-speed railway station area in our country is difficult to realize. Through combing and summarizing the existing research, this paper finds out that the comprehensive development of high-speed railway station area is difficult to achieve. The imperfection of land value-added income distribution mechanism in the comprehensive development of high-speed railway station area is one of the main reasons that hinder the comprehensive development of high-speed railway station area. This paper attempts to discuss the formation and distribution of land increment in the process of comprehensive development of high-speed railway stations in big cities of China under the current system. Assuming that China's construction land use right stratification system has been improved, the existing high-speed railway station area comprehensive development process of land value-added income distribution to the local government is unfair. In the process of comprehensive development of new high-speed railway station area, the distribution of land value-added income is unfair to the main body of railway, but the lack of mechanism of fair distribution of land value-added income hinders the comprehensive development of high-speed railway station area in big cities of our country. This paper systematically arranges and compares the land value-added income distribution mechanism in the comprehensive development of high-speed railway (rail transit) stations at home and abroad. Finally, this paper combines the current situation of our country. The method of land value-added income distribution in the process of comprehensive development of high-speed railway stations in big cities of China is selected. On the Distribution Mechanism of Land Value-added income in Comprehensive Development of existing High-speed Railway stations in Big cities of China. . In the near future, the local government and the railway main body can participate in the land development and share the value-added income of the land development link, in the long run, after the railway main body has the development ability. The main body of the railway can be developed independently after taking charge of the construction of the public supporting facilities or paying a certain amount of matching fee. About the land value-added income distribution mechanism in the comprehensive development of the newly-built high-speed railway stations in the big cities of our country. In the near future, tax return should be adopted, which can be subdivided into two ways, one is that the local government will return the tax to the main railway, the other is to reasonably determine the average land price when there is no high-speed railway in the high-speed railway station area. And then return the more part of the land transfer fee to the railway main body; After the main body of the railway has the ability to develop, it can be used to determine the regional average land price of the surrounding land when the high-speed rail is not built, so as to transfer the right to use the surrounding land to the main body of the track. The way by which the main body of the railway is independently developed or developed in cooperation with the developer.
