【摘要】：旨在調(diào)控房價(jià)非理性增長的限購令,具有實(shí)質(zhì)法治意義上的正當(dāng)性。民法學(xué)界的指詰,援引古典契約自由理論,認(rèn)為限購令以戶籍限制干預(yù)合同自由,并危害法治秩序。但僅基于形式正義理念進(jìn)行體系化的邏輯推理,難以維護(hù)法和社會秩序的安定價(jià)值,游離于法教義學(xué)思維之外;在法學(xué)研究方法轉(zhuǎn)型、法教義學(xué)獲得重新解讀以及社科法學(xué)已顯端倪的格局中,未能擺脫路徑和方法依賴的民法學(xué)界將面臨極大的挑戰(zhàn)。
[Abstract]:The order of controlling the irrational increase of house price has the legitimacy in the sense of rule of law. Referring to the classical theory of freedom of contract, the civil law circle holds that the purchase restriction order interferes with the freedom of contract with the household registration restriction and endangers the order of ruling by law. However, it is difficult to maintain the stable value of law and social order only based on the concept of formal justice, and it is difficult to maintain the stable value of law and social order. In the pattern of legal dogmatics being reinterpreted and social science law appearing, the civil law circle which can not get rid of the path and method depends on it will face great challenge.
