【摘要】:該論文的作者從法律顧問的視角出發(fā),以房地產(chǎn)企業(yè)為進(jìn)路,圍繞企業(yè)利潤最大化,根據(jù)現(xiàn)行法律法規(guī)和技術(shù)規(guī)范,為房地產(chǎn)企業(yè)提供法律意見,研究房地產(chǎn)項目規(guī)劃設(shè)計民事法律風(fēng)險防范對策。這對企業(yè)將具有重要的實踐意義,有利于企業(yè)滿足消費需求,有效控制成本,防止經(jīng)濟(jì)損失,贏取最大利潤。 全文共分為四章。第一章“房地產(chǎn)項目規(guī)劃設(shè)計及其民事法律風(fēng)險防范的意義”,闡述房地產(chǎn)項目規(guī)劃設(shè)計的含義,及其民事法律風(fēng)險防范的企業(yè)實踐意義。第二章“房地產(chǎn)項目規(guī)劃設(shè)計民事法律風(fēng)險的主要情形”,闡述項目合同預(yù)設(shè)、居住區(qū)規(guī)劃設(shè)計不當(dāng)、建筑規(guī)劃設(shè)計不當(dāng)、規(guī)劃設(shè)計變更等企業(yè)經(jīng)營行為不當(dāng),引起的民事法律風(fēng)險。第三章“房地產(chǎn)項目規(guī)劃設(shè)計民事法律風(fēng)險防范的法律對策”,闡述以項目合同預(yù)設(shè)為主的法律對策,規(guī)避民事法律風(fēng)險,強(qiáng)調(diào)把規(guī)劃設(shè)計的法律措施和技術(shù)要點轉(zhuǎn)化為“規(guī)劃設(shè)計合同”的合同規(guī)范,通過設(shè)計單位使科學(xué)、合理的項目規(guī)劃轉(zhuǎn)化為高質(zhì)量的設(shè)計方案;把項目規(guī)劃設(shè)計要求體現(xiàn)在商品房預(yù)售合同預(yù)設(shè)中,在實體上和程序上規(guī)制規(guī)劃設(shè)計變更。第四章“房地產(chǎn)項目規(guī)劃設(shè)計民事法律風(fēng)險防范的補(bǔ)充對策”,闡述企業(yè)法律風(fēng)險團(tuán)隊、中國傳統(tǒng)建筑景觀學(xué)說、國外企業(yè)實踐的成功經(jīng)驗以及多方參與合作的規(guī)劃設(shè)計模式等措施,對民事法律風(fēng)險防范的積極意義。 論文的創(chuàng)新之處在于,選題新穎,關(guān)注當(dāng)前房地產(chǎn)企業(yè)法律實務(wù)的熱點、前沿問題,側(cè)重可操作性和實用性,提出解決問題的對策措施。
[Abstract]:The authors of the paper from the perspective of legal counsel, in the real estate business as the route, around the enterprise profit maximization, according to the existing laws and regulations and technical specifications, provide legal advice for real estate enterprises, design and Research on the real estate project planning civil legal risk prevention countermeasures. The enterprise will have important practical significance, is conducive to enterprises to meet consumer demand, effective cost control, prevent economic losses, to win the maximum profits.
This paper is divided into four chapters. The first chapter of "real estate project planning and design of civil legal risk prevention", expounds the planning and design of real estate project and the meaning of enterprise practical significance of civil legal risk prevention. The second chapter "main" real estate project planning and design of civil legal risk, expounds the project contract default, residential district planning design and construction planning and design properly, improper design changes such as business misconduct risk caused by civil law. In the third chapter, "the real estate project planning and design of civil legal risk prevention legal countermeasures", elaborates on the Legal Countermeasures of the project contract default, avoid civil legal risk, legal measures to emphasize contract specification and the techniques of planning and design into the design of "contract", the design unit to make scientific and reasonable project planning into high quality The amount of the project design; planning and design requirements embodied in the commercial housing pre-sale contract default, in the substantive and Procedural Regulation of design changes. In the fourth chapter, "the real estate project planning and design of civil legal risk prevention countermeasures", elaborated the enterprise legal risk team, Chinese traditional architectural landscape theory, the successful experience of foreign enterprise practice and participating in the cooperation mode of planning and design measures, on the positive significance of civil legal risk prevention.
The innovation of this paper is that the topic is new, and focuses on the hot topics and frontier issues of the current legal practice of the real estate enterprises. It focuses on operability and practicability, and puts forward some countermeasures to solve the problems.
