我國農(nóng)村職業(yè)教育發(fā)展法律保障研究

【摘要】:職業(yè)教育是我國教育體系的重要組成部分,對(duì)社會(huì)經(jīng)濟(jì)發(fā)展具有重要意義。作為我國農(nóng)村經(jīng)濟(jì)社會(huì)發(fā)展的重要基礎(chǔ)和農(nóng)村教育工作的戰(zhàn)略重點(diǎn),農(nóng)村職業(yè)教育在為農(nóng)民職業(yè)技術(shù)和職業(yè)培訓(xùn)以及農(nóng)村勞動(dòng)力轉(zhuǎn)移方面發(fā)揮著巨大作用。大力發(fā)展農(nóng)村職業(yè)教育,對(duì)有效轉(zhuǎn)移農(nóng)村剩余勞動(dòng)力,解決“三農(nóng)”問題,有效推進(jìn)城鄉(xiāng)統(tǒng)籌發(fā)展起著標(biāo)本兼治的作用。進(jìn)入新世紀(jì)以來,伴隨著《國家中長期教育改革和發(fā)展規(guī)劃綱要(2010—2020)》的出臺(tái),農(nóng)村職業(yè)教育的快速健康發(fā)展被提上國家的重要議事日程。但與其快速發(fā)展之不相適應(yīng)的是:目前我國整個(gè)職業(yè)教育法律法規(guī)建設(shè)(包括農(nóng)村職業(yè)教育)非常滯后,相關(guān)的法律規(guī)范非常缺乏,本應(yīng)以法律進(jìn)行規(guī)范的內(nèi)容在現(xiàn)實(shí)中往往表現(xiàn)為一系列的政策制定,其權(quán)威性與有效性被大大降低,根本無法滿足農(nóng)村職業(yè)教育發(fā)展的需要,同時(shí)也與世界職業(yè)教育法制化發(fā)展的潮流相違背。 鑒于此,本文將以如何實(shí)現(xiàn)教育公平,促進(jìn)農(nóng)村職業(yè)教育法制化為研究視角,分析我國農(nóng)村職業(yè)教育法制建設(shè)現(xiàn)狀及其法制建設(shè)過程中存在的主要問題;在對(duì)我國農(nóng)村職業(yè)教育立法現(xiàn)狀進(jìn)行相關(guān)分析的基礎(chǔ)上,思考如何從法律層面構(gòu)建農(nóng)村職業(yè)教育的良好運(yùn)行環(huán)境,最后結(jié)合相關(guān)分析的結(jié)果,同時(shí)借鑒美、日、德等發(fā)達(dá)國家職業(yè)教育立法的成功經(jīng)驗(yàn),為建立適應(yīng)我國農(nóng)村職業(yè)教育發(fā)展的職業(yè)教育法律法規(guī)保障體系提出了幾點(diǎn)試探性的建議。
[Abstract]:Vocational education is an important part of China's education system, which is of great significance to social and economic development. As an important foundation of rural economic and social development and the strategic focus of rural education, rural vocational education plays an important role in providing vocational and technical training for farmers as well as the transfer of rural labor force. The development of rural vocational education plays an important role in effectively transferring rural surplus labor force, solving the problem of "agriculture, countryside and farmers" and effectively promoting the overall development of urban and rural areas. Since the beginning of the new century, with the introduction of the National medium and long term Education Reform and Development Program (2010-2020), the rapid and healthy development of rural vocational education has been put on the important agenda of the country. However, with the rapid development of vocational education, the construction of laws and regulations of vocational education (including rural vocational education) is lagging behind, and the relevant laws and regulations are very lacking. The content which should be standardized by law is often manifested as a series of policy formulation in reality, whose authority and effectiveness are greatly reduced, and can not meet the needs of the development of rural vocational education. At the same time, it also runs counter to the trend of legalization development of vocational education in the world. In view of this, this article will take how to realize the education fair, promotes the countryside vocational education legalization as the research angle, analyzes our country countryside vocational education legal system construction present situation and the legal system construction process main question; Based on the analysis of the current situation of rural vocational education legislation in China, the author thinks about how to construct a good operating environment of rural vocational education from the legal level, and finally combines the results of relevant analysis, and at the same time draws lessons from the United States and Japan. The successful experience of vocational education legislation in Germany and other developed countries puts forward some tentative suggestions for the establishment of a guarantee system of vocational education laws and regulations adapted to the development of rural vocational education in China.
