【摘要】：我國(guó)高校享有高度的自主管理權(quán)，隨著高等教育的大眾化，高校因?qū)W生管理問題而引發(fā)的糾紛也日益增多，這不僅折射出高校管理與法律法規(guī)之間的矛盾，也反映了學(xué)生的維權(quán)意識(shí)更加強(qiáng)烈。如何解決和處理高校學(xué)生事務(wù)管理中存在的敏感問題，推進(jìn)高校學(xué)生事務(wù)管理的民主和法治化，已經(jīng)引起廣泛的關(guān)注。聽證程序作為行政程序的核心引入我國(guó)高校學(xué)生事務(wù)管理，，特別是在高校學(xué)生違紀(jì)處理中發(fā)揮著重要的作用，對(duì)規(guī)范和監(jiān)督高校正確行使處分權(quán)，促進(jìn)高校管理法治化，保護(hù)高校學(xué)生的合法權(quán)益，無論在理論上還是在實(shí)踐中都具有非常重要的意義。 本文運(yùn)用理論分析、文獻(xiàn)研究和比較分析的方法對(duì)高校學(xué)生違紀(jì)處理聽證問題進(jìn)行了研究。首先闡述本文的選題背景和現(xiàn)實(shí)意義，分別對(duì)國(guó)內(nèi)外相關(guān)文獻(xiàn)進(jìn)行了綜合敘述，試圖對(duì)高校學(xué)生違紀(jì)處理聽證程序進(jìn)行具體構(gòu)建與完善，以此提出高校學(xué)生違紀(jì)處理中聽證程序建設(shè)的新思路，為高校管理法治化發(fā)展，構(gòu)建和諧校園增添新的內(nèi)容。其次，從聽證及聽證制度、高校學(xué)生事務(wù)管理的內(nèi)涵入手，闡述了高校學(xué)生違紀(jì)處理聽證制度建設(shè)的理論依據(jù)。同時(shí)，對(duì)高校學(xué)生違紀(jì)處理引入聽證制度的情況進(jìn)行了分析，從聽證的適用范圍、聽證的主體、聽證的具體程序以及聽證筆錄等方面存在的問題進(jìn)行了概括，并剖析了導(dǎo)致問題產(chǎn)生的原因。此外，通過了解國(guó)美國(guó)高校學(xué)生違紀(jì)處理聽證制度特點(diǎn)，為我國(guó)高校在學(xué)生違紀(jì)問題中更好適用聽證制度提供經(jīng)驗(yàn)借鑒與啟示。文章最后從思想觀念、法制建設(shè)、聽證制度內(nèi)容以及人才隊(duì)伍建設(shè)等方面提出的相關(guān)對(duì)策建議對(duì)完善我國(guó)高校學(xué)生違紀(jì)處理聽證制度有著重要的參考借鑒價(jià)值。
[Abstract]:Colleges and universities in our country enjoy a high degree of independent management power. With the popularization of higher education, there are more and more disputes caused by student management in colleges and universities, which not only reflects the contradiction between university management and laws and regulations, but also reflects the stronger awareness of students' rights protection. How to solve and deal with the sensitive problems existing in the management of student affairs in colleges and universities and promote the democracy and rule of law in the management of student affairs in colleges and universities has attracted extensive attention. As the core of administrative procedure, hearing procedure introduces the management of student affairs in colleges and universities in our country, especially in dealing with violations of discipline in colleges and universities, which plays an important role in standardizing and supervising the correct exercise of disposition power in colleges and universities, promoting the legalization of university management and protecting the legitimate rights and interests of college students, both in theory and in practice. In this paper, theoretical analysis, literature research and comparative analysis are used to study the hearing of college students dealing with disciplinary violations. First of all, this paper expounds the background and practical significance of this topic, and makes a comprehensive description of the relevant literature at home and abroad, and tries to construct and perfect the hearing procedure of college students in violation of discipline, so as to put forward a new idea of the construction of hearing procedure in the treatment of disciplinary violations, so as to add new contents to the development of the rule of law in the management of colleges and universities and the construction of a harmonious campus. Secondly, starting with the connotation of hearing and hearing system and student affairs management in colleges and universities, this paper expounds the theoretical basis for the construction of hearing system for college students to deal with disciplinary violations. At the same time, this paper analyzes on the introduction of the hearing system into the treatment of violations of discipline in colleges and universities, summarizes the problems existing in the scope of application of the hearing, the main body of the hearing, the specific procedures of the hearing and the record of the hearing, and analyzes the causes of the problems. In addition, by understanding the characteristics of the hearing system for students in colleges and universities in China and the United States, this paper provides experience, reference and enlightenment for colleges and universities in our country to better apply the hearing system to the problem of students violating discipline. Finally, the paper puts forward some relevant countermeasures and suggestions from the aspects of ideology, legal system construction, hearing system content and talent team construction, which has important reference value for perfecting the hearing system of college students dealing with violations of discipline in our country.
