【摘要】：一些學(xué)者根據(jù)相關(guān)法律法規(guī)習(xí)慣性地推斷,政府是法律意義上大學(xué)章程的"應(yīng)然制定主體"�，F(xiàn)實(shí)中大學(xué)章程的制定主體是大學(xué),然而這種由大學(xué)來制定的章程基本是"一紙空文",難以發(fā)揮大學(xué)章程應(yīng)有的作用。根據(jù)"依法治教"、"自主管理"的需要,政府或大學(xué)都不能單獨(dú)作為章程的制定主體。借鑒美國確立大學(xué)章程制定主體——董事會的相關(guān)經(jīng)驗(yàn),并結(jié)合國情,我國大學(xué)章程制定主體應(yīng)當(dāng)是由多方利益主體共同構(gòu)成的"中國式"董事會。
[Abstract]:According to the relevant laws and regulations, some scholars habitually conclude that the government is the "The main body should be established" of the university's constitution in the legal sense. The main body of the university's articles of association is the university, however, the articles of association developed by the university are basically the "a paper-and-paper", and it is difficult to play the role of the university's articles of association. According to the needs of the "to teach in accordance with the law" and the "autonomous management", neither the government nor the university can act as the main body of the articles of association. Based on the experience of the establishment of the subject _ board of association in the United States, and in the light of the national conditions, the main body of the university's constitution should be the "Chinese style" 's board of directors.
