【摘要】：大學(xué)生創(chuàng)業(yè)逐漸成為備受關(guān)注的社會(huì)的熱點(diǎn)現(xiàn)象。通過以創(chuàng)業(yè)帶動(dòng)就業(yè),大學(xué)生創(chuàng)業(yè)在體現(xiàn)大學(xué)生自身價(jià)值的同時(shí),也能有效的緩解社會(huì)就業(yè)壓力。我國政府相繼出臺(tái)了一系列法律規(guī)章,肯定、鼓勵(lì)、扶持大學(xué)生進(jìn)行創(chuàng)業(yè),為大學(xué)生在創(chuàng)業(yè)指導(dǎo)、稅收優(yōu)惠、融資貸款等方面的創(chuàng)業(yè)權(quán)益提供了法律制度保障。但是,在具體創(chuàng)業(yè)實(shí)踐中也存在創(chuàng)業(yè)指導(dǎo)缺乏制度約束,,創(chuàng)業(yè)立法層次較低,知識(shí)產(chǎn)權(quán)保護(hù)不力,創(chuàng)業(yè)制度可操作性不強(qiáng),社會(huì)保障制度不配套等問題,嚴(yán)重影響了大學(xué)生創(chuàng)業(yè)的熱情和創(chuàng)業(yè)效果,也說明了我國對(duì)于大學(xué)生創(chuàng)業(yè)權(quán)益的法律保障亟需加強(qiáng)。在國外,發(fā)達(dá)國家非常重視大學(xué)生創(chuàng)業(yè)權(quán)益的法律保障,在創(chuàng)業(yè)指導(dǎo)、創(chuàng)業(yè)融資、創(chuàng)業(yè)社會(huì)保障等方面都制定了相應(yīng)的法律規(guī)范,建立了完善的大學(xué)生創(chuàng)業(yè)權(quán)益法律保障體系。參照發(fā)達(dá)國家的先進(jìn)經(jīng)驗(yàn),為更好的保障大學(xué)生創(chuàng)業(yè)權(quán)益,我國應(yīng)在確立大學(xué)生創(chuàng)業(yè)權(quán)益法律保障制度立法原則的基礎(chǔ)上,通過提升促進(jìn)大學(xué)生創(chuàng)業(yè)的立法層次,促進(jìn)大學(xué)生創(chuàng)業(yè)具體法律法規(guī)建設(shè),完善現(xiàn)有大學(xué)生創(chuàng)業(yè)權(quán)益法律法規(guī),加強(qiáng)大學(xué)生創(chuàng)業(yè)社會(huì)保障法律制度等方式加強(qiáng)大學(xué)生創(chuàng)業(yè)權(quán)益法律保障制度建設(shè),進(jìn)一步建立和完善大學(xué)生創(chuàng)業(yè)權(quán)益法律保障體系。
[Abstract]:College students' entrepreneurship has gradually become a hot phenomenon in the society. By using entrepreneurship to promote employment, college students' entrepreneurship reflects the value of college students, but also can effectively alleviate the pressure of social employment. Our government has issued a series of laws and regulations, affirming, encouraging, and supporting college students to start a business, which provides a legal system guarantee for university students' entrepreneurial rights and interests in such aspects as entrepreneurship guidance, tax concessions, financing loans and so on. However, there are also some problems in the practice of entrepreneurship, such as the lack of institutional constraints on entrepreneurship guidance, the low level of entrepreneurship legislation, the weak protection of intellectual property rights, the weak operability of the entrepreneurial system, and the lack of a supporting social security system. It seriously affects the enthusiasm and effect of college students' entrepreneurship, and it also shows that the legal protection of university students' entrepreneurial rights and interests needs to be strengthened in our country. In foreign countries, the developed countries attach great importance to the legal protection of university students' entrepreneurial rights and interests, and have formulated corresponding legal norms in the aspects of entrepreneurial guidance, venture financing and social security of entrepreneurship, and have established a perfect legal protection system for university students' entrepreneurial rights and interests. Referring to the advanced experience of the developed countries, in order to better protect the entrepreneurial rights and interests of college students, our country should establish the legislative principles of the legal protection system of the university students' entrepreneurial rights and interests, and improve the legislative level of promoting the university students' entrepreneurship. To promote the construction of specific laws and regulations on university students' entrepreneurship, to improve the existing laws and regulations on university students' entrepreneurial rights and interests, and to strengthen the legal system of university students' entrepreneurial rights and interests by strengthening the legal system of social security for university students' entrepreneurship. We will further establish and improve the legal protection system for university students' entrepreneurial rights and interests.
