教育法視角下我國高校自主權(quán)的保障機制研究

【摘要】:近年來,隨著高等教育體制的改革,高校自主權(quán)問題逐漸成為理論界研究的對象,已成為高等教育領(lǐng)域改革的焦點。因為其既是高等教育學(xué)領(lǐng)域的問題,又涉及法學(xué)的理論知識,所以更受教育學(xué)及法學(xué)方面的專家學(xué)者的關(guān)注。在我國的法律規(guī)范中,對高校自主辦學(xué)活動中的權(quán)利做了簡要的規(guī)定,并規(guī)定了高校在民事活動中的獨立法人資格,這些規(guī)定對于推進高校自主權(quán)的落實與完善具有重要的意義。但是通過對高校辦學(xué)自主權(quán)實施現(xiàn)狀的分析,我們發(fā)現(xiàn)高校的辦學(xué)活動仍遭受著來自政府的過度干預(yù),高校自主權(quán)并未得到實現(xiàn),為此,如何確保高校自主權(quán)的順利落實便成為需要我們思考的問題,也是本文的研究對象。 本文以高校自主權(quán)的概念這一基本問題為著眼點進行了分析,認為高校自主權(quán)是指高校依據(jù)法律和政策,遵照教育教學(xué)規(guī)律,結(jié)合其自身目標定位和辦學(xué)特點,以學(xué)術(shù)自由為核心內(nèi)容而進行的自主決策、自主執(zhí)行和自主監(jiān)督的權(quán)能。其次,運用實證分析方法對高校自主權(quán)的實施過程中存在問題及其成因進行了分析。鑒于我國高校自主權(quán)的實現(xiàn)還面臨著諸多問題和障礙,本文結(jié)合我國具體國情,試圖從教育法角度構(gòu)建我國高校自主權(quán)的保障機制,即包括以下四個方面的對策:一是要明確界定校府關(guān)系,確定高校自主辦學(xué)的主體資格;二是將高校自主權(quán)寫入憲法,使之獲得憲法保護;三是明確高校在自主辦學(xué)中的權(quán)利、義務(wù)與責(zé)任,高校在自主辦學(xué)活動中要依法進行,勇于擔(dān)當(dāng);四是要完善高校自主權(quán)的監(jiān)督機制。 如何保障我國高等學(xué)校的自主權(quán)是一項系統(tǒng)而復(fù)雜的工程,涉及面廣,且不是一蹴而就的。本文僅僅是一次初淺的探索,期望運用有效的管理機制和措施,來不斷完善我國高校的自主權(quán)并保障其能順利實施。本文提到的我國高校僅指我國大陸地區(qū)的公立高等學(xué)校。
[Abstract]:In recent years, with the reform of higher education system, the autonomy of colleges and universities has gradually become the object of theoretical research, and has become the focus of reform in the field of higher education. Because it is not only a problem in the field of higher education, but also a theoretical knowledge of law, it is paid more attention by experts in pedagogy and law. In the legal norms of our country, the rights in the independent school running activities of colleges and universities are briefly stipulated, and the independent legal personality of colleges and universities in civil activities is stipulated. These regulations are of great significance to the implementation and perfection of the autonomy of colleges and universities. However, through the analysis of the present situation of implementing the autonomy of running a university, we find that the school running activities of colleges and universities are still subject to excessive interference from the government, and the autonomy of colleges and universities has not been realized. How to ensure the smooth implementation of the autonomy of colleges and universities has become a problem that we need to think about, and it is also the object of this paper. Based on the analysis of the concept of autonomy in colleges and universities, this paper holds that the autonomy of colleges and universities refers to the orientation of their own goals and characteristics of running a school in accordance with the laws and policies, in accordance with the laws of education and teaching, and with the combination of their own objectives and characteristics of running a school. The power of independent decision-making, autonomous execution and independent supervision with academic freedom as its core content. Secondly, the paper analyzes the problems and causes in the process of implementing the autonomy of colleges and universities by using the empirical analysis method. In view of the fact that there are still many problems and obstacles in the realization of the autonomy of colleges and universities in our country, this paper tries to construct the guarantee mechanism of the autonomy of colleges and universities from the angle of education law according to the specific conditions of our country. That is to say, the countermeasures include the following four aspects: first, to clearly define the relationship between the university and the government, and to determine the main qualifications of the independent running of the university; The second is to write the autonomy of colleges and universities into the constitution so that it can be protected by the constitution, the third is to make clear the rights, obligations and responsibilities of colleges and universities in the process of running a school independently. Fourth, we should perfect the supervision mechanism of the autonomy of colleges and universities. How to guarantee the autonomy of colleges and universities in China is a systematic and complex project involving a wide range and not accomplished overnight. This paper is only a preliminary exploration, hoping to use effective management mechanism and measures to continuously improve the autonomy of colleges and universities in China and ensure its smooth implementation. The universities mentioned in this paper only refer to the public institutions of higher learning in mainland China.
