【摘要】：我國(guó)高等教育近年來(lái)的蓬勃發(fā)展,對(duì)高校的內(nèi)部管理提出了更高、更新的要求,而大學(xué)章程是高校內(nèi)部管理制度的首要內(nèi)容,在高校內(nèi)部管理中占有統(tǒng)領(lǐng)性地位。制定科學(xué)、合理的大學(xué)章程,有利于將大學(xué)管理納入法制化的軌道,保障了大學(xué)辦學(xué)自主權(quán)的真正獲得,有利于我國(guó)現(xiàn)代大學(xué)制度的建立和完善。同時(shí),大學(xué)章程也有助于提升學(xué)校的整體實(shí)力,促進(jìn)我國(guó)一流大學(xué)向世界一流大學(xué)邁進(jìn)。 本研究首先通過(guò)對(duì)大學(xué)章程的定義進(jìn)行分析,界定大學(xué)章程的具體內(nèi)涵,同時(shí)也對(duì)高校的內(nèi)部管理體制進(jìn)行了界定,通過(guò)此界定明確我國(guó)大學(xué)章程在推動(dòng)內(nèi)部管理體制改革方面應(yīng)規(guī)范的內(nèi)容,并且具體論述了大學(xué)章程的發(fā)展歷史和對(duì)現(xiàn)狀進(jìn)行分析,力圖尋找目前我國(guó)公辦大學(xué)制定與實(shí)施章程的過(guò)程中存在的問(wèn)題；其次,對(duì)國(guó)外的大學(xué)章程分別從內(nèi)部管理體制改革的四個(gè)方面即大學(xué)內(nèi)部行政機(jī)構(gòu)的設(shè)置、內(nèi)部隸屬關(guān)系、權(quán)限的劃分和其他制度進(jìn)行了文本的剖析,探究其性質(zhì)；再次,對(duì)國(guó)內(nèi)制定并公布的大學(xué)章程進(jìn)行文本分析,闡述我國(guó)公辦大學(xué)章程建設(shè)的不足；最后,針對(duì)我國(guó)公辦大學(xué)章程建設(shè)中存在的問(wèn)題,提出大學(xué)章程制定和實(shí)施過(guò)程中的具體建議,以促進(jìn)我國(guó)現(xiàn)代大學(xué)制度的建立與完善。 本文的創(chuàng)新點(diǎn)在于,總結(jié)國(guó)外大學(xué)章程建設(shè)在內(nèi)部管理體制上的規(guī)定的經(jīng)驗(yàn)和教訓(xùn),深入分析了我國(guó)大學(xué)章程建設(shè)在內(nèi)部管理體制上存在的不足,并提出了完善我國(guó)大學(xué)章程建設(shè)推進(jìn)內(nèi)部管理體制改革的建議：大學(xué)內(nèi)部行政機(jī)構(gòu)設(shè)置、隸屬關(guān)系、權(quán)限劃分與運(yùn)行中的各種制度應(yīng)按照現(xiàn)代大學(xué)“黨委治政、校長(zhǎng)治校、教授治學(xué)、民主管理”的邏輯,對(duì)內(nèi)部管理體制加以全方位的改革。
[Abstract]:The vigorous development of higher education in China in recent years has put forward higher and newer requirements for the internal management of colleges and universities, and the university charter is the primary content of the internal management system of colleges and universities, which occupies a dominant position in the internal management of colleges and universities. The establishment of scientific and reasonable university regulations is conducive to bringing university management into the orbit of legalization, ensuring the real acquisition of the autonomy of running a university, and conducive to the establishment and improvement of the modern university system in China. At the same time, the university charter also helps to enhance the overall strength of the university, and promote the first-class university to the world-class university. This study firstly analyzes the definition of the university charter, defines the specific connotation of the university charter, and also defines the internal management system of the university. Through this definition, it is clear that the university charter of our country should be standardized in promoting the reform of the internal management system, and the history of the development of the university charter and the analysis of the present situation are discussed in detail. This paper tries to find out the problems existing in the process of making and implementing the regulations of the public universities in our country at present. Secondly, the article of association of foreign universities is divided into four aspects of the reform of internal management system, that is, the establishment of the internal administrative organs and the internal subordinate relationship of the universities. The division of authority and other systems of text analysis, explore its nature; thirdly, the text analysis of the university charter made and published in China, expound the shortcomings of the constitution construction of public universities in China; finally, In view of the problems existing in the constitution construction of public universities in our country, the paper puts forward some concrete suggestions in the course of making and implementing the university charter in order to promote the establishment and perfection of the modern university system in China. The innovation of this paper is to sum up the experience and lessons of the internal management system of the university charter construction in foreign countries, and to analyze deeply the deficiencies in the internal management system of the university charter construction in our country. The paper also puts forward some suggestions on how to perfect the constitution construction of universities and promote the reform of internal management system: the establishment of internal administrative organs, the relationship of subordination, the division of jurisdiction and the various systems in operation should be carried out in accordance with the modern university "party committee governing the government and the president governing the school." The logic of teaching scholarship and democratic management reforms the internal management system in all directions.
